    591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm¶s length away from children thirty- six (36) months of age and younger.

    During a Monitoring Visit conducted on April 29, 2026 ; It was determined based on observation that watchful oversight was not provided during mealtime in the following classrooms: -Room 178-Infant 2(Right) when Center staff were not seated within an arm's length away from two infants that were eating in high chairs. -Room 177-Infant 3(Left) when Center staff were not seated within an arm¶s length away from three 1- year-old children that were eating lunch.     During a Complaint Closure conducted on June 23, 2025 ; It was determined based on an investigation that April 28, 2025 a 2-year-old child sustained a leg injury that required professional medical attention when their foot was pushed into the middle partition of a door frame while riding in a Bye-Bye buggy. The staff member failed to ensure all children had their hands and feet inside the buggy before exiting. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm's length away from children thirty-six (36) months of age and younger.going to the bathroom; punish toileting accidents; force-feed a child or withhold feeding a child regularly scheduled meals and/or snacks; force or withhold naps; allow children to discipline or humiliate other children; or confine a child for disciplinary purposes to a swing, highchair, infant carrier, walker or jump seat.

    During an investigation, it was determined that on April 28, 2025, a 2-year-old child sustained an injury to their left leg after their foot was caught in the door frame partition while being transported in a Bye-Bye buggy. The staff member did not verify that all children had their hands and feet securely inside the buggy prior to exiting the building. The staff member stated they opted for a buggy ride due to wet playground conditions and typically reminds children to keep their arms and legs inside the cart. However, as they exited, the child extended a leg outside the buggy, resulting in the injury. The staff member repositioned the child’s foot, provided verbal redirection, and continued the ride. Another staff member later observed the child crying silently, prompting them to stop, assess the child, and escort her to the front office where ice was administered. Professional medical attention was obtained.

    During an investigation, it was determined that the Director or designated person-in-charge failed to report an incident that occurred on April 28, 2025, when a 2-year-old child sustained a leg injury that required professional medical attention within the required 24-hour timeframe, as required by the Department.

    During a complaint closure on October 8, 2021, it was determined that on August 25, 2021, at approximately 10:30 a.m., two staff members transitioned 10 one-year-old children from outside to play in an unlicensed lobby area. After the one-year-old children played in the unlicensed lobby area, the two staff members transitioned the one- year-old children back to their classroom. While in the classroom, preparing for lunch, a staff member (staff A) conducted a head count and noticed that a one-year-old child was missing. The other staff member (staff B) walked out the classroom and observed an infant staff member holding the one-year-old child in the unlicensed lobby area. Staff B escorted the child back to the classroom. The child was unattended for an undetermined amount of time between 40 seconds and 15 minutes. Medical attention was not obtained.
