Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm¶s length away from children thirty- six (36) months of age and younger.

    During a Monitoring Visit conducted on November 2, 2023 ; It was determined based on observation that there were three separate times that a staff person walked out of the classroom to retrieve breakfast from the kitchen and left the children unattended. In addition, during the time of 8:10 a.m. until 8:35 a.m.one staff person was observed supervising children in the right classroom and middle classroom. The staff person was not aware when a two-year-old child bit two other children in the middle classroom.

    During a Licensing Study conducted on May 22, 2024 ; It was determined based on observation and pictures taken that upon arrival to the center, staff # 3 was sleeping in the rocking chair in the infant classroom, with two infants in their cribs sleeping, from 10:50 am to 11:00 am when woken by the assistant director. Additionally, from 10:50 am to 11:12 am, a three-year-old child was sleeping in a highchair in the right classroom with no adult present. Additionally, from 10:50 am to 11:00 am and from 11:05 am to 11:10 am, a two-year-old child was sleeping in a highchair in the middle classroom with no adult supervision. Exhibit "A"
