    591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children shall be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.

    During an investigation, it was determined that on February 4, 2025, a five-year-old child was left on the center’s bus unsupervised for an undetermined amount of time. The child stated he fell asleep on the bus on the way to the center from school and was left on the bus once arriving at the center. The child tried to get off the bus, but the door was locked. The child knocked on the bus window and another parent who was passing by, heard it and notified staff that the child was left alone on the bus.

    591-1-1-.36(7)(c)2 · Rule 591-1-1-.36(7)(c)2 requires that the driver or other designated person shall immediately document in writing, with a check or other mark/symbol to account for each child listed on the passenger transportation checklist each time a child enters and exits the vehicle. The driver or other designated staff person shall document in writing with a different mark/symbol to account for each child listed on the passenger transportation checklist who was not present on the vehicle for any reason. An explanation shall be documented in writing whenever a child is transported to a field trip site but is not present on the return trip to the Center.

    During an investigation, it was determined that on February 4, 2025, a five-year-old child was not accounted for during the unloading of the center vehicle. The transportation log had been completed, but was not used correctly, when a five-year-old child, who had fallen asleep, was left on the vehicle. The transportation log indicated the child exited the vehicle, but the child remained on the center's vehicle for an undetermined amount of time.

A parent that was passing by heard the child knocking on the vehicle’s window and alerted staff that the child was on the vehicle and could not get off. A staff person went to the vehicle and assisted the child in getting off the vehicle.

    During an investigation, it was determined that on February 4, 2025, a five-year-old child was left on the center’s vehicle for an undetermined amount of time, and the parent was not notified as required. The child notified their parent of the incident after leaving the center and arriving home. The parent notified the center of the incident on February 5, 2025.

    591-1-1-.36(4)(f)1 · Rule 591-1-1-.36(4)(f)1 requires all children transported in a vehicle provided by or used by the Center shall be secured in a child passenger restraining system or seat safety belt in accordance with current state and federal laws and regulations. The child passenger restraining system and seat safety belts must be installed and used in accordance with the manufacturer's directions for such system and used in accordance with the manufacturer’s directions with respect to restraining, seating or positioning the child being transported in the vehicle.

    During an investigation, it was determined that on December 9, 2024, a five-year-old child sustained an injury to the mouth and teeth after hitting his mouth on the vehicle window, due to not being restrained properly. Staff stated the restraints on the vehicle were in working order, but the child was not buckled properly. The child was observed to be standing on the floor, in front of the seat, when the incident occurred. The injury required professional medical attention.

    During an investigation, it was determined that on December 9, 2024, a five-year-old child sustained an injury to the mouth and teeth that required professional medical attention and two teeth were removed.
