591-1-1-.15(9) · Rule 591-1-1-.15(9) requires that a written statement be on file from a medical authority when a child requires a modified diet for medical reasons and from the child's Parent(s) when a child requires a modified diet for religious reasons. All caregiver Personnel shall be informed of the diet restriction for the child and only food that complies with the prescribed dietary regimen but still meets the food and nutrition requirements shall be served to the child.

During an investigation, it was determined that on May 20, 2025, a 2-year-old child was served a hummus sandwich containing sesame, a documented allergen for the child. Staff members in the classroom confirmed with the meal preparation staff person that the child could receive the hummus sandwich. The child consumed two pieces of the sandwich during lunch time. During nap time, the child awakened and appeared to be fussy. A staff person noticed that the child had a rash all over their body and that the child exhibited signs of an allergic reaction. The child’s parent was contacted, and a staff member administered cream and Zyrtec medication. The child was transported to their pediatrician by the parent and then to the hospital by ambulance to receive professional medical treatment. The child was diagnosed with an allergic reaction due to consuming sesame, a restricted food item.
