591-1-1-.15(9) · Rule 591-1-1-.15(9) requires that a written statement be on file from a medical authority when a child requires a modified diet for medical reasons and from the child's Parent(s) when a child requires a modified diet for religious reasons. All caregiver Personnel shall be informed of the diet restriction for the child and only food that complies with the prescribed dietary regimen but still meets the food and nutrition requirements shall be served to the child.
During an investigation, it was determined that on October 10, 2025, a 3-year-old child with a documented seafood allergy was served fish during lunch. The child consumed the fish and then vomited after lunch. The child was taken by the parent for professional medical attention and was treated for an allergic reaction. The allergy was indicated on the child’s enrollment form; however, center staff that served the child were unaware of the child’s allergy until after the incident occurred. In addition, the center did not have a written statement from a medical authority on file as required.

591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students- in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.

During an investigation, it was determined that on August 1, 2023, a three-year-old child was left alone in the childcare center after hours for approximately two hours. It was determined that staff members did not provide watchful oversight to prevent the incident from occurring. The staff members did not count the children before exiting the classroom at the end of the day to ensure that all children were accounted for. Neither did the staff members check the bathroom to ensure that no child was left.

591-1-1-.32(9) · Rule 591-1-1-.32(9) requires that immediately prior to the Center closing and being locked at the end of the business day, the Staff member charged with the responsibility of locking the Center shall make a physical inspection of the entire premises to verify that no child is left on the Center's premises.
