During an investigation, it was determined that on May 13, 2025, staff persons did not promptly intervene when three children began to run in the classroom and a 2-year-old child fell, resulting in a serious injury to their mouth. The child hit their mouth on a child sized chair. Staff were aware that the children were running and both staff persons were putting out plates for lunch. Staff persons verbally redirected the children but did not physically intervene before the child fell. The child received professional medical treatment.

During an investigation, it was determined that on May 13, 2025, staff persons did not respond promptly to a child’s distress signal when three children began to run in the classroom and a 2-year-old child fell, resulting in a serious injury to their mouth. The child immediately cried out and remained on the floor. Eighteen seconds after the child fell, one staff person walked toward the table to put down plates of food and noticed blood on the floor and picked the child up. A laceration was observed in the crease of the child’s mouth. The child received professional medical treatment.

591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children shall be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.
During an investigation, it was determined that on February 2, 2022, at approximately 2:00 p.m., in the classroom, watchful oversight was not provided when a one-year-old child pulled a microwave handle causing the microwave to tip over and the hot water on top of the microwave to slide on the floor splashing on the child’s leg. At the time of the incident, one staff member was standing holding a child, preparing to change the child’s diaper. The other staff member was seated in a chair feeding a child their bottle. Meanwhile, a one-year-old child reached to pull the handle on the microwave open, at that time the child fell causing the microwave to tip over and the cup of hot water placed on top of the microwave to slide on the floor splashing on the one-year-old child’s leg. When the incident occurred, staff were not aware that the one-year-old child was pulling on the microwave handle, and therefore, did not provide watchful oversight to prevent the incident. The child required professional medical attention.

591-1-1-.12(4) · Rule 591-1-1-.12(4) requires that equipment shall be secured if it is of a weight or mass that could cause injury from tipping, falling, or being pulled or pushed over. When a one-year-old child pulled on the microwave door handle it caused the microwave to tip over. A cup of hot water placed on top of the microwave slid off and fell on the floor splashing onto a one-year-old child’s leg. The child required professional medical attention.
