591-1-1-.26(9) · Rule 591-1-1-.26(9) requires the playground to be kept clean, free from litter and free of hazards, such as but not limited to rocks, exposed tree roots and exposed sharp edges of concrete.

During an investigation, it was determined that on April 7, 2022, a four-year-old child sustained an injury to their arm when the child was riding a tricycle on a poured rubber mulch riding track and bridge. The child’s tricycle wheel became stuck in a pothole as they exited the bridge. The tricycle fell over and the child sustained a broken arm and dislocated elbow. The riding track was observed to be in disrepair and posed a hazard, which resulted in the four- year-old child falling while riding the tricycle on the riding track. The child required professional medical attention as a result of the incident.

591-1-1-.03(9) · Rule 591-1-1-.03(9) requires center staff to refrain from engaging in, or allowing children or other adults to engage in, activities that could be detrimental to a child’s health or well-being, such as but not limited to, horse play, rough play, wrestling, and picking up a child in manner that could cause injury.

During an investigation, it was determined that on April 7, 2022, a four-year-old child sustained an injury to their arm when the child was allowed to ride a tricycle on a poured rubber mulch riding track and bridge that was observed by staff to have a large pothole at the bottom of the bridge. The child’s tricycle wheel became stuck in the pothole as they exited the bridge. The tricycle fell over and the child sustained a broken arm that required professional medical attention. The center staff was aware that the riding track was in disrepair and did not take measures to prevent the child from accessing the area and allowed the child to continue to use the riding track.
