    591-1-1-.03(9) · Rule 591-1-1-.03(9) requires that staff shall not engage in, or allow children or other adults to engage in, activities that could be detrimental to a child’s health or well-being, such as but not limited to, horse play, rough play, wrestling, and picking up a child in a manner that could cause injury.

    During an investigation, it was determined that on January 15, 2025, staff did not intervene when a 3-year-old child climbed a piece of playground equipment that was not intended for climbing. There were 14 children with one staff member on the playground. The teacher was positioned behind the play equipment as they monitored the playground. The children played on a double-sided 3 foot, 5 inch tall store panel with a window in the center. Child A stepped onto child B's hand as they stepped onto the window to climb to the top of the panel. Child B stood up from their squatting position at the window, then used their left foot to climb to the top of the panel. The staff member walked to the far-right side of the play structure, as the children were on the play structure. During this time, Child A attempted to hold themselves up at the top of the store panel, and Child B then attempted to climb over the store panel. Child A lost their grip and fell from the top of the store panel, onto the turf, as Child B attempted to climb over the store panel. Child A then stood up from the turf and pushed Child B over the top of the store panel, causing child B to fall, resulting in an arm injury that required professional medical attention.

    591-1-1-.12(1) · Rule 591-1-1-.12(1) requires that all indoor and outdoor furniture, activity materials, and equipment shall be used: in a safe and appropriate manner by each Employee and child in attendance; and in accordance with the manufacturer’s instructions, recommendations, and intended use. All equipment and furniture shall be used only by the age-appropriate group of children.

    During an investigation, it was determined that on January 15, 2025, a three-year-old child was injured while on the playground. The three-year-old child did not utilize the outdoor slide climber equipment in an appropriate manner. The child climbed the playground equipment, a store panel which was not permitted for climbing. The additional child pushed the 3-year-old over the top of the store panel, which caused the 3-year-old to fall from the top of the store panel. The 3-year-old child sustained an injury to the left forearm that required professional medical attention.

    591-1-1-.10(4) · Rule 591-1-1-.10(4) requires that if diapers are changed on a diaper changing surface, the surface shall be smooth, nonporous, and equipped with a guard or rails to prevent falls. Between each diaper change, the diaper changing surface shall be cleaned with a disinfectant and dried with a single-use disposable towel.

    During a complaint investigation, it was determined that on June 20, 2024, a two-year-old child sustained chemical burns on their back and upper arms after they were changed on a diapering table that was not properly dried. At the time of the incident, there were two staff members with 16 two-year-old children in the classroom. The two-year- old child was wearing a one-piece romper that had to be pulled down when getting a diaper changed. During naptime, the child was observed to be tossing and turning when a staff member noticed the child’s back to be red. According to staff, prior to changing the child, a staff member cleaned the changing mat with soap, water, and a premixed solution called Sani 512. As a result of the staff members not thoroughly drying the changing surface after use, the child sustained a chemical reaction burn to their back that required professional medical attention.

    591-1-1-.29(3) · Rule 591-1-1-.29(3) requires the Director or designated person-in-charge shall report or cause to be reported to the Department within twenty-four (24) hours or the next work day: any death of a child while in the care of the Center; any serious illness or injury requiring hospitalization or professional medical attention other than first aid of a child while in the care of the Center; any situation when a child in care becomes missing, such as, but not limited to, a child who is left on a vehicle, a child who leaves the building, playground, or property, or a child who is left behind on any trip; any fire; any structural disaster; any emergency situation that requires temporarily relocating children; and any time the program’s operating status changes (i.e., open to closed or temporarily closed and temporarily closed to open).

    During a complaint investigation closure, it was determined that on June 20, 2024, a two-year-old child sustained a chemical reaction burn to the back. On June 21, 2024, the center management was notified that the two-year-old child received professional medical attention. The center did not report the incident to the Department within 24 hours or the next work day as required.
