    591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.

    During an investigation, it was determined that on February 14, 2024, at approximately 10:45 a.m. a three-year-old child fell from a seesaw and hit their nose on a metal bar. Staff members witnessed the child standing on the seesaw inappropriately, and the child was verbally and physically redirected. The child continued to return to the equipment. Staff members failed to position themselves in a manner to provide watchful oversight in order to prevent the child from returning and climbing on the equipment. Staff stated that they did not witness the injury. The child received professional medical attention. 2. 591-1-1-.12(1) requires each Employee and child in attendance to use all indoor and outdoor furniture, activity materials, and equipment in a safe and appropriate manner and in accordance with the manufacturer's instructions, recommendations, and intended use. All equipment and furniture shall be used only by the ageappropriate group of children. During an investigation, it was determined that on February 14, 2024, at approximately 10:45 a.m. the center allowed three-year-old children to use a seesaw play structure that according to the manufacturer's instructions was recommended for five to twelve-year-old children. A three-year-old child fell from the play structure and injured their nose. Professional medical attention was obtained.

    It was determined based on investigative findings that on May 6, 2022, at approximately 4:00 p.m., a three- year-old child sustained an injury to the finger when a staff member shut the door leading from the playground on the three-child-old child's fingers. The staff member was entering the classroom to change another child’s clothing and did not provide supervision and watchful oversight to check to determine that the three-year-old child was behind her. The staff member on the playground conducted a head count and realized that the three- year-old child was unaccounted for. The staff member and some of the older children began searching for the child. The three-year-old child was located on the adjacent playground with a finger injury. The three- year-old child sustained an injury that required professional medical attention.
