591-1-1-.32(7) · Rule 591-1-1-.32(7) requires children shall be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.
During an investigation, it was determined that on September 30, 2024, a 10-year-old child was slapped on the face while on the center vehicle by another enrolled child, while being transported from school to the center. Once at the center, the altercation continued on the playground, without staff knowledge. The altercation took place in the back of the playground area where the child was slapped, kicked, held down on the ground, and body slammed on the rocks and grass. The staff member was observed to be at the front of the playground braiding a child’s hair and unaware of the incident. The child sustained a head and arm injury. Professional medical attention was required.

Additionally the top, back of the front passenger seat was observed to be ripped, exposing foam. The transportation van with the license plate AKI 3540 was observed to have a cracked windshield and the back passenger double door did not open from the outside. Furthermore, duct tape was observed to be used to repair a hole on top and side of the first bench seat.
