591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in- Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.
It was determined based on an investigation that on July 8, 2024, at approximately 2:30 p.m., a two-year-old child sustained an injury to their right pinky finger when their finger was closed in the classroom door. The teacher was not aware that while they were heading towards the classroom door, a two-year-old child was following behind them. When the teacher closed the door, the staff members heard the two-year-old child crying. The staff member noticed that the child’s finger was in the door and opened the door to release their finger. Professional medical attention was required.

Video footage showed that one staff member entered the classroom from the playground with three children. A second staff member sent an additional two children into the classroom. The two-year-old child was playing on a tree climbing structure at the other end of the playground. The second staff member entered the classroom, leaving the child alone on the playground. Approximately 10 minutes later another staff member went to an adjacent playground to pick up toys and observed the child. The staff member retrieved the child and returned them to the classroom.
