During an investigation, it was determined that on August 6, 2025, adequate supervision was not provided when a 5-year-old child sustained an injury to the left forearm after climbing up a piece of playground equipment and falling to the ground. At the time of the incident, one staff member was present with five school-age children. The staff member was retrieving a basketball and was not aware that the child had climbed on an area of a playground structure that was not intended to be climbed upon. The staff was unaware that the child had fallen until they were notified by other children. The child received professional medical attention and was diagnosed with a broken forearm.

591-1-1-.12(1) · Rule 591-1-1-.12(1) requires all indoor and outdoor furniture, activity materials, and equipment shall be used in a safe and appropriate manner by each Employee and child in attendance and in accordance with the manufacturer's instructions, recommendations, and intended use. During a complaint investigation and follow-up visit conducted on May 21, 2025, it was determined based on observation that in Building 1 Front 1st Right classroom, seven 3-year-old children were unsupervised for sixty seconds.

591-1-1-.11(2) · Rule 591-1-1-.11(2) requires that Personnel not: physically or sexually abuse a child or engage or permit others to engage in sexually overt conduct in the presence of any child enrolled in the Center; inflict corporal/physical punishment upon a child; shake, jerk, pinch or handle a child roughly; verbally abuse or humiliate a child which includes, but is not limited to, the use of threats, profanity or belittling remarks about a child or his family; isolate a child in a dark room, closet or unsupervised area; use mechanical or physical restraints or devices to discipline children; use medication to discipline or control children's behavior without written medical authorization issued by a licensed professional and given with the parent's written consent; restrict unreasonably a child from going to the bathroom; punish toileting accidents; force-feed a child or withhold feeding a child regularly scheduled meals and/or snacks; force or withhold naps; allow children to discipline or humiliate other children; or confine a child for disciplinary purposes to a swing, highchair, infant carrier, walker or jump seat.

It was determined based on an investigation that on April 29, 2025, at approximately 3:00 p.m. staff in the after- school classroom inappropriately disciplined a 10-year-old child. The investigation determined that a staff member grabbed a 10-year-old child by their left arm and shoulder, pushed the child into the door causing the child to hit their left arm, back and left eye on the door as a form of discipline when the child would not comply. Staff placed their foot on the back of the child's shoe to prevent the child from crawling away. The child sustained bruises and a scratch.
