    591-1-1-.25(13) · Rule 591-1-1-.25(13) requires that potentially hazardous equipment, materials and supplies be stored in a locked area inaccessible to children.

    During a Complaint Investigation & Licensing Study conducted on March 21, 2023 ; It was determined based on investigative findings that hazardous materials and supplies were accessible to the children. Consultant observed a staff person's purse in reach of children in classroom A. Furthermore, consultant observed diaper cream to be accessible to children in classroom B and C.

    591-1-1-.12(2) · Rule 591-1-1-.12(2) requires that all equipment and furniture be free from hazardous conditions such as, but not limited to, sharp rough edges or toxic paint; and be kept clean.

    During a Complaint Closure conducted on April 11, 2023 ; It was determined that on February 21, 2023, toys and equipment that were wet with bleach and water were accessible to the children when a one- year-old child sustained chemical burns on both arm. Two staff persons in the classroom cleaned the toys, due to dust created by construction the day before. A child sized table was covered with a plastic trash bag. After the toys were cleaned with bleach and water, they were placed on the table to air dry. Additionally, there was a bin with toys, soaking in bleach and water, on the floor beside the table. That afternoon, staff persons observed a rash on the back of both of the child¶s arms. The following day, staff persons observed the rash had developed into blisters. The child received professional medical treatment and was diagnosed with chemical burns. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.
