    591-1-1-.36(7)(c)2. · Rule 591-1-1-.36(7)(c)2. requires that the driver or other designated person shall immediately document in writing, with a check or other mark/symbol to account for each child listed on the passenger transportation checklist each time a child enters and exits the vehicle. The driver or other designated staff person shall document in writing with a different mark/symbol to account for each child listed on the passenger transportation checklist who was not present on the vehicle for any reason. An explanation shall be documented in writing whenever a child is transported to a field trip site but is not present on the return trip to the Center.

    During a Licensing Study conducted on September 17, 2024 ; It was determined based on observation the transportation route for Clarkdale Elementary September 9-13, 2024 was missing the load and unload checks for Monday and Thursday.

    591-1-1-.26(8) · Rule 591-1-1-.26(8) requires climbing and swinging equipment to have a resilient surface beneath the equipment and the fall zone from such equipment must be adequately maintained by the Center to assure continuing resiliency.

    During an Incident Investigation, it was determined that on January 23, 2023, a four-year-old child fell off of swinging equipment on the playground and sustained a fractured left arm due to inadequate resilient surfacing underneath the outdoor equipment. Approximately four and a half inches of mulch was measured underneath the swing when at least six inches was required. Due to the inadequate resilient surface beneath the swing, the resilient surface was unable to provide a buffer and prevent the child’s injury.
