    591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm¶s length away from children thirty- six (36) months of age and younger.

    During a Licensing Study conducted on October 10, 2024 ; It was determined based on observation that Staff #121 in the Two-Year-Old Room was in the closet getting out cots and set out cots around the classroom while children were seated eating lunch and was not within arm's length away from the children as required. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

    During an investigation, it was determined that on June 24, 2024, around 2:30 p.m., 12 children and one staff member were present. A parent arrived to pick up their three-year-old, who was getting up from nap time. As the parent and child were leaving the center, the child complained of arm pain, favoring the right arm and screaming when it was lifted. The parent returned to inquire about the injury, but staff were unaware of any incident and could not provide any information as to what happened to the child. The center failed to provide adequate oversight, in that staff were unaware of how the injury occurred. The child sustained an injury to the right elbow, which required medical attention.

    During an investigation, it was determined that on June 24, 2024, at approximately 2:30 p.m., a three-year-old child was observed to favor their right arm and scream out when the child’s arm was lifted. There was a total of twelve children and one staff member present when a three-year-old child injured their arm, and the center staff could not explain what happened to the child. According to the child’s parent, the child complained to the parent that their right arm was hurting. When the child’s parent inquired with the center staff, the staff member informed the parent that they were not aware of any incidents with the child. According to staff statements, the staff member also informed the parent that the three-year-old child had been crying throughout the day and thought the child was crying due to a previous illness. The center staff failed to notify the child’s parent that the child was in discomfort while at the facility. The department determined the center failed to keep the three-year-old child comfortable when the child was observed to be crying throughout the day. The child required professional medical attention as a result of an incident that occurred at the center.

    During an investigation, it was determined that on June 24, 2024, a three-year-old child was observed to favor their right arm and scream out when their arm was lifted. At approximately 2:30 p.m. the three-year-old child's parent arrived at the center. As the child’s parent walked into the classroom, the three-year old child was getting up from a mat from napping. The three-year-old child complained to their parent that their arm was hurting. When the parent questioned staff, the parent was informed that the three-year-old child had been crying throughout the day and staff thought the child was crying due to a previous illness. The department determined the center failed to notify the parent that the three-year-old child was observed to be crying throughout the day.

    During a complaint closure it was determined that on April 1, 2024, it was determined based on an investigation which included staff statements and interviews, on November 7, 2023, at approximately 4:00 p.m., two staff members were supervising seven one-year-old children in the classroom. Staff member A stated they heard the one- year-old child begin to get upset. Staff member A stated they noticed that the child was injured after they observed a mark and a blister on the child’s finger/hand. Staff member B stated they did not observe the injury but noticed the imprint on the top of the child’s finger. Based on these findings it was determined that staff were not aware of this and did not prevent the incident from occurring. The Department determined that staff members did not provide appropriate supervision and watchful oversight when the incident occurred.
