591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. During an investigation, it was determined that on January 7, 2025, watchful oversight was not provided to a five- year-old child who was left on the center van unattended in the center's parking lot. The children loaded the vehicle at approximately 7:30 a.m. and conducted routine morning school transportation. The vehicle returned to the center at approximately 8:15 a.m. and the driver parked the vehicle. The staff member exited the vehicle and the child attempted to get the staff member’s attention, however the driver appeared to be talking to someone, exited the vehicle, and went inside the building, which resulted in the five-year-old child being left unsupervised on the van for six hours and 15 minutes.

591-1-1-.36(7)(c)2. · Rule 591-1-1-.36(7)(c)2. requires that the driver or other designated person shall immediately document in writing, with a check or other mark/symbol to account for each child listed on the passenger transportation checklist each time a child enters and exits the vehicle. A five-year-old child entered the vehicle at approximately 7:30 a.m. and the staff conducted routine school transportation, returning to the center at approximately 8:15 a.m. Center staff did not conduct a name or face check of all children as they exited the vehicle, which resulted in a five- year-old child being left unsupervised on the van for six hours and 15 minutes. Center staff found the child around 1:45 p.m. when they noticed movement in the van.

The staff member signed the checklist to indicate that the first check of the vehicle had been completed, however the check was not completed as required.

During an investigation, it was determined that on September 7, 2022, the after-school class was outside on the playground with a staff:child ratio of 1:12 school-age children. Supervision was not maintained when the staff person was not aware that a seven-year-old child had fallen from the climbing equipment until the child walked to the staff person to state that they had fallen from the equipment and hit their head. It was also determined that the staff member was unaware of the piece of equipment the child fell from. Additionally, it was determined that the teacher had another student walk the injured child into the building without adult supervision. Professional medical attention was obtained.
