591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children shall be supervised at all times appropriate to the individual age, $499.00 needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers, and Students-in-Training. The persons supervising in the childcare area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.
During an investigation, it was determined that on December 16, 2021, center staff failed to provide supervision and watchful oversight when a two-year-old child was allowed to use a child- sized rocking-chair inappropriately. The child was observed on video for approximately one minute and thirty-eight seconds sitting in a child sized rocker on the knees facing the back of the rocker. The child rocked back and forth with such momentum that the rocker moved across the room. The child fell forward onto the face and sustained extensive dental injury that required professional medical attention.

During an investigation, it was determined that on December 16, 2021, a two-year-old child was allowed to use a child sized rocking chair inappropriately. The supervising center staff failed to ensure that the child used the furniture in an appropriate manner in accordance with the intended use. The supervising center staff walked past the child on two separate occasions and failed to ensure that the child discontinued to use the equipment in an unsafe manner.

During an investigation, it was determined after a review of records and interviews, a two-year-old child sustained an injury while in the care of the Center. The center was informed that a two-year-old child received professional medical treatment on December 16, 2021. The center did not report the injury to the department until December 20, 2021.

591-1-1-.11(2) · Rule 591-1-1-.11(2) requires that Personnel not: physically or sexually abuse a child or engage or permit others to engage in sexually overt conduct in the presence of any child enrolled in the Center; inflict $299.00 corporal/physical punishment upon a child; shake, jerk, pinch or handle a child roughly; verbally abuse or humiliate a child which includes, but is not limited to, the use of threats, profanity or belittling remarks about a child or his family; isolate a child in a dark room, closet or unsupervised area; use mechanical or physical restraints or devices to discipline children; use medication to discipline or control children's behavior without written medical authorization issued by a licensed professional and given with the parent's written consent; restrict unreasonably a child from going to the bathroom; punish toileting accidents; force- feed a child or withhold feeding a child regularly scheduled meals and/or snacks; force or withhold naps; allow children to discipline or humiliate other children; or confine a child for disciplinary purposes to a swing, highchair, infant carrier, walker or jump seat.
It was determined based on an investigation that on March 26, 2021, a staff member caused a one-year-old child to sustain an injury to the left elbow. At 10:41 a.m. a staff member roughly pulled the child up from the floor by both wrists. The child was then pulled a short distance to the changing table by the left arm. The staff member picked the child up by both arms and placed the child on the changing table. The child immediately cried and held the left arm during the diaper change. The child continued to cry and held the left arm after the diaper change was conducted. The staff member called office personnel for assistance at 11:09 a.m. due to the child’s continued crying and holding their left arm for an extended period of time. The child’s parents were contacted regarding the injury and the child received professional medical attention that date and was diagnosed with a left Nursemaid's Elbow. Following management’s review of the classroom video, the staff member was immediately terminated for the incident. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.
