591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. During a Complaint Closure conducted on May 22, 2023 ; It was determined that during the week of April 10, 2023, adequate supervision was not provided when a one-year-old child ingested five pea gravel rocks while on the playground. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

During a Complaint Closure conducted on October 17, 2023 ; It was determined based on an investigation that on September 11, 2023, a one-year-old child was bitten by a known biter when one staff member was changing diapers and the other staff member had their back to the book area where the child received the bite. On September 19, 2023, a staff member was observed to allow a child to play with their shoe without intervening after the child hit another child in the head with the shoe. Exhibit "A"

591-1-1-.03(9) · Rule 591-1-1-.03(9) requires center staff to refrain from engaging in, or allowing children or other adults to engage in, activities that could be detrimental to a child's health or well-being, such as but not limited to, horse play, rough play, wrestling, and picking up a child in a manner that could cause injury.

It was determined based on an investigation that on February 24, 2022, at approximately 4:55 p.m., a three-year-old child sustained Nursemaid’s Elbow when a staff person pulled the child’s arm up in an attempt to stand the child up off the floor. Professional medical attention was obtained.
