591-1-1-.30(1)(a) · Rule 591-1-1-.30(1)(a) requires that a crib that is safety approved in compliance with Consumer Product Safety Commission (CPSC) and American Society of Testing and Materials International (ASTM) safety standards shall be provided for each infant. During an investigation, it was determined that on September 21, 2021, a one-year-old child sustained a cut to the finger when it was closed, by a staff person, in the drop rail of a crib. The crib was not safety approved. The child required professional medical treatment and the cut was closed with liquid glue.

591-1-1.32(7) · Rule 591-1-1.32(7) requires children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. “Supervision” means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children’s actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.

During an investigation, it was determined that on September 21, 2021, watchful oversight was not provided to prevent a one-year-old child’s finger from being closed in the drop rail of a crib, which resulted in a cut. Staff were preparing to go outside to the playground, by using the evacuation crib. A staff person placed the child in the crib and raised the side, catching the child’s finger. First aid was rendered, and the child’s parent was notified. The child received professional medical treatment and the cut was closed with liquid glue.
