    591-1-1-.12(1) · Rule 591-1-1-.12(1) requires each Employee and child in attendance to use all indoor and outdoor furniture, activity materials, and equipment in a safe and appropriate manner and in accordance with the manufacturer’s instructions, recommendations, and intended use. All equipment and furniture shall be used only by the age-appropriate group of children.

    During an investigation, it was determined that on July 7, 2022, a partial drop-side crib was not used in a safe and appropriate manner when an eleven-month-old child sustained a head injury when the partial drop side of the crib, being used by the child, came unlatched and the child fell out of the crib. A staff person observed the child standing in the crib, shaking the side with both hands. The partial drop side of the crib opened and the child fell out. The child landed on their side, hitting their head on the floor. The child was crying and was observed to be very drowsy. The child was brought to management, who attempted to locate a nurse on campus. A nurse could not be located, and the child’s parent was contacted. The child received professional medical treatment and was diagnosed with a serious head injury. Based on a physical inspection of the crib, one or both latches could not have been fully engaged which allowed the partial drop side to open without first manually disengaging the latches.

    591-1-1-.07(2) · Rule 591-1-1-.07(2) requires Center Staff to immediately notify Parents and obtain specific instructions until the child can be picked up or returned to the group when professional medical attention is required, or when the child experiences symptoms of moderate discomfort such as elevated temperature, vomiting or diarrhea and to notify Parents by the end of the day when professional medical attention is not required, when the child experiences symptoms of less than moderate discomfort or when the child experiences an adverse reaction to prescribed medication which does not constitute moderate discomfort.

    During an investigation, it was determined that on July 7, 2022, parents of an eleven-month-old child were not immediately notified when the child fell out of a crib, hitting their head on the floor, after nap time. The child displayed symptoms of moderate discomfort by crying and acting very drowsy. The incident occurred at 11:33 a.m. The parent was contacted at 11:55 a.m. The child received professional medical treatment and was diagnosed with a serious head injury.
