591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children shall be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision” means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.

During a Complaint Closure conducted on September 1, 2023; It was determined based on an investigation that on August 9, 2023, during afternoon dismissal, staff was observed to not provide adequate supervision when the staff member did not respond promptly the needs and actions of the children in care. One staff was caring for seven one- year-old children when the staff member had their back to the children for several minutes as children pushed the table and chairs around the area, climbed on chairs, and climbed on top of the table. The staff member walked next to a child that was standing on a chair and did not respond to the child’s actions. The child fell from the chair and remained motionless for several minutes. The staff looked in the direction of the children multiple times and stepped over the child laying on the floor as they passed by but did not respond to the child’s needs. The child sustained a head injury as a result of the fall and professional medical attention was required.

591-1-1-.03(8) · Rule 591-1-1-.03(8) requires that personnel shall provide individual attention to each child. Examples include, but are not limited to: responding promptly to the child's distress signals and need for comfort; playing with and talking to the children; and providing and assisting the child with personal care in a manner appropriate to the child's age level, i.e., providing the child privacy in dressing, diapering and toileting functions as the developmental age of the child dictates.

During an investigation, it was determined that on August 9, 2023, center staff failed to provide individual attention to a one-year-old child, who remained lying on the floor for approximately ten minutes after falling from a chair. The child climbed onto the chair and remained standing for several minutes until they fell onto the floor. The child laid on the floor motionless for several minutes as the staff member continued to stand with their back to the children and at one point the staff member stepped over the child as they remained motionless on the floor for several minutes. The staff member did not respond to the child, assess the child for injuries, and provide comfort to the child. The child sustained a head injury as a result of the incident and required professional medical attention.

591-1-1-.03(9) · Rule 591-1-1-.03(9) requires center staff to refrain from engaging in, or allowing children or other adults to engage in, activities that could be detrimental to a child's health or well-being, such as but not limited to, horse play, rough play, wrestling, and picking up a child in a manner that could cause injury.

During an investigation, it was determined that on October 1, 2021, an infant child sustained a burn on the right ankle when a staff member reached for a bottle out of the bottle warmer causing the hot water to leak on the infant. The infant’s foot was observed to be red and peeling. Professional medical attention was obtained.

591-1-1-.29(3) · Rule 591-1-1-.29(3) requires the Director or designated person-in-charge to report or cause to be reported to the Department within twenty-four (24) hours or the next work day: any death of a child while in the care of the Center; any serious illness or injury requiring hospitalization or professional medical attention other than first aid of a child while in the care of the Center; any situation when a child in care becomes missing, such as, but not limited to, a child who is left on a vehicle, a child who leaves the building, playground, or property, or a child who is left behind on any trip; any fire; any structural disaster; any emergency situation that requires temporarily relocating children; and any time the program’s operating status changes (i.e., open to closed or temporarily closed and temporarily closed to open)

During an investigation, it was determined that on October 1, 2021, an infant received professional medical attention as a result of an injury while in care. The provider was aware that the infant received professional medical attention and did not report the incident to the Department as required.

591-1-1-.32(2) · Rule 591-1-1-.32(2) requires the Center maintain Staff:child ratios in mixed-age groups based on the age of the youngest group of children that includes more than twenty percent of the total number of children in the mixed-age group.

During an investigation, it was determined based on staff statement and documentation that the center failed to maintain adequate staff to child rations on October 1, 2021, when one staff member cared for three infants, five one- year-olds, and fifteen two-year-old children enrolled in care. Three staff persons were required.
