    591-1-1-.03(9) · Rule 591-1-1-.03(9) requires center staff to refrain from engaging in, or allowing children or other adults to engage in, activities that could be detrimental to a child’s health or well-being, such as but not limited to, horse play, rough play, wrestling, and picking up a child in a manner that could cause injury.

    During an investigation, it was determined that on August 29, 2024, a two-year-old child sustained a right arm injury when center staff pulled the child up by the wrist while the child was lying down on the floor. After transitioning from outside play the child laid down in the library area. When it was time for a table activity, the staff member attempted to get the child up by pulling the child up by the wrist. The child required professional medical attention and was diagnosed with an arm injury.

    591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in- Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.

    During an investigation, it was determined that on October 25, 2023, at 10:58 a.m., staff members failed to actively supervise and provide watchful oversight to children on the playground, when the staff members were unaware that a four-year old child fell off of the fireman platform climbing structure until they heard the child crying. Professional medical attention was obtained. ,

The responsible person shall physically walk through the entire vehicle; visually inspect all seat surfaces, under all seats and in all compartments or recesses in the vehicle's interior; and sign the passenger transportation checklist(s), indicating all of the children have exited the vehicle. During a Licensing Study conducted on May 25, 2023 ; It was determined based on review of records that the driver did not document in writing the time of arrival of the vehicle during the following times of routine transportation on May 15, 2023: Return time to facility was not noted for afternoon transportation from Lilburn Elementary School and the return time to facility was not noted for afternoon transportation from Rebecca Minor Elementary School. 3. B. Rule 591-1-1-.36(7)(c )3. requires that the driver or other designated person document in writing the time of arrival and departure each time the vehicle departs from the Center, is loaded or unloaded at each school and when the vehicle returns to the Center; each time the vehicle departs from the Center, arrives at the location where any child is picked up or dropped off and when the vehicle returns to the Center; each time the vehicle leaves the Center, arrives at a field trip destination, leaves a field trip destination, and returns to the Center.
