    591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.

    During a Complaint Closure conducted on May 8, 2025, it was determined based on an investigation, that on March 25, 2025, at 10:43 a.m. a 3-year-old child was injured while in care. There were two staff members and 16 children on the playground at the time of the incident. The staff members did not provide adequate supervision when they were not alert or positioned to hear and see the children at all times when a 3-year-old child was engaged in rough play and was injured. The 3-year-old child was taken to a medical facility for treatment and was diagnosed with a fracture of the right clavicle.

    During a Complaint Closure conducted on March 21, 2025, it was determined based on an investigation that on February 6, 2025, at approximately 5:17 p.m., a one-year-old child walked out of the center unsupervised. There were three staff members and 11 children in the classroom at the time of the incident. The staff members did not provide adequate supervision when they were not alert or positioned to hear and see the children at all times when a one-year-old child walked out of the classroom and into the parking lot. The uninjured one-year-old child was determined to be unsupervised for 2 minutes and 37 seconds.

    During an investigation, it was determined that on February 6, 2025, staff members did not provide adequate supervision when a one-year-old child got out of the building and was found in the center’s parking lot by a parent. Staff members were talking to another parent when the incident occurred. Video footage showed the child followed a family out of the building and staff were unaware the child was missing. The child was missing for two minutes and thirty-seven seconds. Professional medical attention was not required.
