591-1-1-.03(9) · Rule 591-1-1-.03(9) requires that Staff shall not engage in, or allow children or other adults to engage in, activities that could be detrimental to a child’s health or well-being, such as but not limited to, horse play, rough play, wrestling, and picking up a child in a manner that could cause injury.
During an investigation, it was determined that on October 24, 2024, at 3:50 p.m., a 2-year-old child climbed on an overturned shelf, jumped off, and struck their head on another shelf, resulting in a cut above their left eye that required professional medical attention. There were 2 staff members with 12 children in the classroom. As one staff member changed a child’s diaper, another staff member assisted a child with putting on their shoes. As this occurred, children climbed on furniture, jumped off tables and shelves, and overturned a shelf in the classroom with no verbal or physical redirection from staff members. As a parent entered the classroom, one of the staff members began talking with the parent, and the other staff member went to the nearest table and removed the children standing on the table. As the other staff member walked to the child standing on the shelf, the child jumped and struck their head on a nearby shelf. First aid was administered, and the parent was contacted. The 2-year-old child was taken for professional medical attention received stitches for the cut. Staff failed to verbally redirect the children’s unsafe activities or physically intervene, which resulted in the 2-year-old child hitting their head on a shelf.

It was determined, based on investigative findings, that on October 3, 2024, at 7:20 a.m., center staff failed to protect a ten-month-old child from unintentional injury when they attempted to hold two children at the same time while transitioning the children from the Infant One Classroom. The staff member lost their grip, as the child fell and hit their head and face on the carpet. The child’s parent was contacted, and the child was picked up from the center at 9:21 a.m. Due to the center staff’s harmful and detrimental activity, the child required professional medical attention and was diagnosed with abrasions to their right upper eyebrow and right upper cheek.

During an investigation, it was determined that on October 3, 2024, at 7:20 a.m., a staff member dropped a ten- month-old infant while attempting to hold two children at the same time in the infant one classroom. According to video footage, there were two teachers with four children in the classroom. Staff member 1 held one child on their right side/hip and staff member 2 held an additional child in their left arm. Staff member 2 assisted staff member 1 when readjusting child 2 into their hold on their left hip. While transitioning, staff member 1 proceeded to use their knees to readjust child one and child two on their hips as they exited the classroom. Staff member 2 then proceeded to pick up child three and placed them onto their left hip. Staff member 2 then proceeded to pick up child four and placed them onto their right hip. Staff member 2 attempted to readjust child four with their right arm, lost their grip, spun around, as child four flipped backwards and over the staff member’s shoulder. Staff member 2 failed to protect the child’s safety due to picking up a child in a manner that could cause injury. The child required professional medical attention as a result of the incident.

591-1-1-.26(4) · Rule 591-1-1-.26(4) requires that playgrounds be protected from traffic or other hazards by a (4) four foot high fence or other barrier approved by this Department. Fencing material shall not present a hazard to children and shall be maintained so as to prevent children from leaving the playground area by any means other than through an approved access route. Fence gates shall be kept closed except when persons are entering or exiting the area.
During an investigation, it was determined that on January 31, 2024, a two-year-old child tripped and fell hitting their head on a screw sticking out of the fence, resulting in the child receiving a cut about their left eye. The children were transitioning from the playground back into the center and both the center staff and children were cleaning up the playground. The child tripped and hit their head on a screw that was protruding from a post for the playground gate. The child required professional medical attention as a result of the incident.
