591-1-1-.03(9) · Rule 591-1-1-.03(9) requires center staff to refrain from engaging in, or allowing children or other adults to engage in, activities that could be detrimental to a child's health or well-being, such as but not limited to, horse play, rough play, wrestling, and picking up a child in a manner that could cause injury.
During an investigation, it was determined that on March 26, 2026, at approximately 10:55 a.m. staff members failed to intervene and deter children from throwing wooden blocks, resulting in a 4-year-old child being struck in the face. During free play, a staff member observed children throwing blocks while in the block area. Both staff members that were present were seated on the floor in separate areas of the classroom and did not physically intervene to stop the unsafe activity. One of the children threw another block into the air and as it came down, the block hit the 4- year-old child in the face. The 4-year-old child received professional medical attention for a cut near their eye.

During an Incident Investigation Closure conducted on January 4, 2023 ; It was determined based on investigative findings that on December 15, 2022 a staff member grabbed a ten-year-old child by their left arm and pulled the child in an attempt to remove the child from the classroom for approximately one minute and 25 seconds. The child sustained a small, red scratch on their left forearm.

591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm¶s length away from children thirty- six (36) months of age and younger.
During an Incident Investigation Closure conducted on June 8, 2023 ; It was determined that on May 5, 2023, approximately 10:53 a.m., staff members failed to actively supervise and provide watchful oversight of the children on the play equipment which resulted in an injury to the four-year-old child falling from the equipment. Staff did not observe that two children were using the spring rider inappropriately or when the four-year-old fell. Professional medical attention was sought. Exhibit "A"
