During a Complaint Closure conducted on January 13, 2025 ; It was determined based on an investigation that on December 19, 2024, center staff did not provide watchful oversight and were not alert and did not respond to the actions of a seven-year-old child when the child sustained a knot on the forehead with scrapes around the side of their face. The staff person revealed that they observed the seven-year-old child sitting in the chair with their knees bent touching their chest, tucked inside of their shirt and their feet on the seat of the chair, when the staff person verbally redirected the child to remove their knees and sit correctly. The staff person stated that they turned their back to talk to another child when they heard the seven-year-old child fall and immediately started crying. Professional medical was obtained. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

During an Incident Investigation Closure conducted on May 19, 2025 ; It was determined based on an investigation that at approximately 4:01 p.m. on April 30, 2025, a three-year-old child exited the classroom and was alone and unsupervised on the playground for approximately 46 seconds. During an investigation and follow-up visit conducted on May 14, 2025, it was determined based on an investigation that on April 30, 2025, staff were unaware that a 3-year-old child exited the classroom and went to the playground alone. The child was missing for approximately forty-six seconds. Staff were unaware the child opened the classroom door that led to the playground and exited the room. Professional medical attention was not required or obtained.

During an Incident Investigation conducted on September 26, 2022, it was determined that on August 4, 2022, staff did not account for a seven-year-old child after transportation. According to staff statements, and supporting evidence, the seven- year-old child was left on the center vehicle, unsupervised for an undetermined amount of time. According to the evidence obtained, the driver of the vehicle exited the vehicle, removed the keys to the vehicle, and left the seven-year-old child unsupervised and unattended for an undetermined amount of time. The child was observed knocking on the front office door of the center.

591-1-1-.36(7)(c)2 · Rule 591-1-1-.36(7)(c)2 requires for all transportation conducted by the Center or on behalf of the Center. A passenger transportation checklist, provided by or in a format approved by the Department, shall be used to account for each child during transportation. A separate passenger checklist shall be used for each vehicle. The driver or other designated person shall immediately document in writing, with a check or other mark/symbol to account for each child listed on the passenger transportation checklist each time a child enters and exits the vehicle. The driver or other designated person shall document in writing with a different mark/symbol to account for each child listed on the passenger transportation checklist who was not present on the vehicle for any reason.
During an Incident Investigation conducted on September 26, 2022, it was determined that on August 4, 2022, staff did not account for a seven-year-old child after transportation. Center staff failed to ensure that a seven-year-old child was not left unattended on a vehicle. The driver failed to accurately use a transportation checklist to account for the unloading of a seven- year-old child and ensure that all the children were exited from the vehicle. The checklist was inaccurately marked to indicate the unloading of the child but in fact the child had not been unloaded from the vehicle. As a result, a seven-year-old child was left unattended on the vehicle for an undetermined amount of time. 3. Rule 591-1-1-.36 (7)(d) 1 requires for all transportation conducted by the Center or on behalf of the Center. The first check shall be conducted immediately upon unloading the last child at any location including, but not limited to, a field trip destination, arrival at the Center, and the last stop during transportation to home or school. The responsible person on the vehicle shall physically walk through the entire vehicle; visually inspect all seat surfaces, under all seats and in all compartments or recesses in the vehicle’s interior; sign the passenger transportation checklist(s), indicating all of the children have exited the vehicle; and give the passenger transportation checklist(s) to the second designated staff person. During an Incident Investigation conducted on September 26, 2022, it was determined that on August 4, 2022, staff did not account for a seven-year-old child after transportation. Center staff failed to conduct a first check of the vehicle to ensure that a seven-year-old child was not left unattended on a vehicle. Center staff failed to conduct a second check of the vehicle to ensure that a seven-year-old child was not left unattended on a vehicle. The staff person failed to conduct the second check of the vehicle upon the completion of the first check and ensure that all the children were exited from the vehicle. The staff person responsible for conducting the second check became distracted and failed to conduct the second check of the vehicle. As a result, a seven-year-old child was left unattended on the vehicle for an undetermined amount of time. 5. Rule 591-1-1-.36(10) Requires supervision of vehicles. A child shall never be left unattended in a vehicle. During an Incident Investigation conducted on September 26, 2022, it was determined that on August 4, 2022 staff did not account for a seven-year-old child after transportation. According to staff statements and supporting evidence, the seven- year-old was left on the center vehicle unsupervised for an undetermined amount of time.
