591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. During an investigation, it was determined that on December 2, 2025, at approximately 7:26 a.m., one staff member transported 13 school-aged children on the center’s vehicle to local elementary schools. A staff member discovered a 7-year-old child was left unsupervised on the Center's vehicle when the child exited the vehicle and entered the building unsupervised. The child boarded the Center's vehicle at 7:38 a.m., and fell asleep during transit. The staff members failed to conduct a head count before the children exited the vehicle. No medical treatment was obtained.

591-1-1-.36(7)(d)1 · Rule 591-1-1-.36(7)(d)1 requires that the first check shall be conducted immediately upon unloading the last child at any location including, but not limited to, a field trip destination, arrival at the Center, and the last stop during transportation to home or school. The child’s parent was not notified immediately upon discovery that the child had been left on the vehicle.

591-1-1-.03(9) · Rule 591-1-1-.03(9) requires center staff to refrain from engaging in, or allowing children or other adults to engage in, activities that could be detrimental to a child's health or well-being, such as but not limited to, horse play, rough play, wrestling, and picking up a child in a manner that could cause injury.
During an investigation, it was determined that on May 31, 2023, a two-year-old child sustained an injury to the back of the head after falling from their chair onto the cubbies. Center staff failed to adequately intervene to ensure that the two-year-old child was not engaging in unsafe activities while sitting in their chair. The child placed their feet on the table prior to falling backwards out of the chair. The two-year-old child received a laceration to the back of their head and required professional medical attention.
