    591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children shall be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.

    During an investigation, it was determined that on December 5, 2025, at approximately 7:30 a.m., adequate supervision was not provided when a 4-year-old child sustained two cuts to the face. One staff member was present in the classroom and was preparing breakfast at the front of the room. The children were located at the back of the room, participating in a music and movement activity. As the staff member stood with their back to the children, the 4-year-old child began to run, fell, and struck their face on a shelf. The staff member was not positioned to see all of the children and became aware of the incident only after hearing the child cry out. The child received professional medical attention for treatment of the cuts.

An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

The staff member did not physically intervene in order to prevent the incident from occurring. The child received professional medical attention as a result of the child's vomiting and complaints of headache. An adverse action was previously issued for this rule violation.     During a Licensing Study conducted on June 2, 2022 ; It was determined based on observation the following hazards were accessible to children in care: Main Building * An optichamber diamond w-med mask spacer with an inhaler labeled, "keep out of reach of children" was located in a child's book bag in the cubby area in the first left classroom. Additionally, there was a hanging cord from a radio that was plugged in and sitting on a table on the right side of the classroom. * Adult scissors and baby wipes labeled as a suffocation hazard were located on top of the cubby area in the fifth left classroom. * A staff member's purse was located on top of the counter in the sixth left classroom. * Plastic walmart bags and sunscreen labeled, "keep out of reach of children" was located in the cubby area in the fifth right classroom. * Triamcinolone acetonide ointment labeled, "keep out of reach of children" was located in the cubby area in the second right classroom. Building Two * A staff member's purse was located in an unlocked closet in the first right classroom.
