591-1-1-.21(3) · Rule 591-1-1-.21(3) requires that the Center conduct drills for fire, tornado and other emergency situations. The fire drills will be conducted monthly and tornado and other emergency situation drills will be conducted every six months. The Center shall maintain documentation of the dates and times of these drills for two years.
During a Complaint Investigation & Licensing Study conducted on November 21, 2023 ; It was determined based on a review of records tornado drills and other emergency drills were not completed as required. Additionally, the smoke detector and fire extinguisher were not checked monthly as required.

The driver or other designated staff person shall document in writing with a different mark/symbol to account for each child listed on the passenger transportation checklist who was not present on the vehicle for any reason. An explanation shall be documented in writing whenever a child is transported to a field trip site but is not present on the return trip to the Center.

Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. “Supervision” means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the childcare area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children’s actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.
During an investigation, it was determined on June 22, 2023, a two-year-old child walked out of the center alone and was found in the parking lot by their relative who arrived to pick up. According to interviews, statements, and a review of video footage at approximately at 1:56 p.m., all the children were being picked up early due to a case of a contagious illness at the center. A staff person escorted the two- year-old child to the front lobby. The staff person spoke briefly to administrator staff and left the two- year-old child in the lobby area alone unsupervised. The management was not aware that the child was in the lobby and could not see the child over the front desk. At approximately 1:57 p.m., three siblings were dismissed for pick up, as the children walked out the front door, the two-year-old child followed behind. At approximately 34 seconds later, video footage showed the child’s relative approaching the front door, holding the two-year-old child. The two-year-old child was not supervised by center staff for approximately 34 seconds, no injuries occurred during this time. The child was examined by emergency personnel as a precaution.

During a Complaint Investigation Follow Up on June 8, 2023, it was determined based on observation there was a lack of supervision in the special use room (cafeteria) upon consultant's arrival as there were 33 children running around the cafeteria area, running in and out of the bathroom, and around the corner of the cafeteria area without the staff member's knowledge or watchful oversight. Additionally, the staff member was not seated within arm's length away from children who were thirty-six months of age during lunchtime as required.

During a Complaint Closure on January 30, 2024, it was determined based on an investigation, that on January 18, 2024, a staff member left one-year-old and two-year-old children alone and unsupervised for approximately six seconds as the staff member took bottles to the adjacent classroom. The staff member reported that was the daily routine.

591-1-1-.11(2) · Rule 591-1-1-.11(2) requires that Personnel not: physically or sexually abuse a child or engage or permit others to engage in sexually overt conduct in the presence of any child enrolled in the Center; inflict corporal/physical punishment upon a child; shake, jerk, pinch or handle a child roughly; verbally abuse or humiliate a child which includes, but is not limited to, the use of threats, profanity or belittling remarks about a child or his family; isolate a child in a dark room, closet or unsupervised area; use mechanical or physical restraints or devices to discipline children; use medication to discipline or control children's behavior without written medical authorization issued by a licensed professional and given with the parent's written consent; restrict unreasonably a child from going to the bathroom; punish toileting accidents; force-feed a child or withhold feeding a child regularly scheduled meals and/or snacks; force or withhold naps; allow children to discipline or humiliate other children; or confine a child for disciplinary purposes to a swing, highchair, infant carrier, walker or jump seat.
During a Complaint Closure conducted on September 9, 2021 ; It was determined based on an investigation, video footage revealed that on August 30, 2021, three-year-old children in care were inappropriately disciplined by a staff member. The staff member was directly in children’s faces as she was observed to yell at them, intimidated them, clinched her fist towards a child, rough handled them by grabbing them by the arm, withheld food for one minute and forced a child to remain standing in time out for approximately two hours. Another staff member was also observed to have a three-year-old child stand in timeout for six minutes instead of three minutes. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

During a Complaint Closure conducted on October 27, 2021 ; It was determined that on October 8, 2021, a two-year-old child was roughly handled by a staff member. Video footage revealed that the child was pulled from underneath a table by the left leg by the staff member. The staff member grabbed the child by the left arm and pulled the child towards her in a rough manner after the child knocked a chair over. The staff member also yelled at the child and told the child to “Get it up!” referring to the chair that the child knocked over. Exhibit "A"

During an investigation, it was determined that a staff member inappropriately discipled multiple three-year-old children on August 30, 2021. Video footage obtained demonstrated the staff member getting directly in children’s faces as she yelled at them, intimidated them, clinched her fist towards a child, rough handled them by grabbing them by the arm, withheld food for one minute and forced a child to remain standing in time out for approximately two hours. Another staff member was also observed to have a three-year-old child stand in timeout for six minutes instead of three minutes.
