591-1-1-.03(9) · Rule 591-1-1-.03(9) requires that staff shall not engage in, or allow children or other adults to engage in, activities that could be detrimental to a child’s health or well-being, such as but not limited to, horse play, rough play, wrestling, and picking up a child in a manner that could cause injury.
During an investigation, it was determined that on January 30, 2026, a 6-year-old child sustained a head and eye injury during rough play that was not stopped by staff members. During outdoor play, a group of children ran and played football, using a stick as the football. A 6-year-old child in the group was tackled by another child, resulting in the 6-year-old child being injured when they were pushed into a wooden fence that surrounded the playground. The child received professional medical attention for a head and eye injury.

591-1-1-.12(8) · Rule 591-1-1-.12(8) requires that toys for children under three (3) years of age shall also be age-appropriate. Those toys shall be non-toxic and lead-free; too large to be swallowed by a child and not capable of causing asphyxiation or strangulation; free of sharp pieces, edges or points; free of small parts which may be pried off by a child, free of rust; and easily cleaned with a disinfectant daily.
During an investigation, it was determined that on April 18, 2024, a one-year-old child’s fingers were ran over by another child that was on a toy motorcycle while on the playground. The motorcycle was manufactured for children three years of age and older. The child cried out but continued to play and act normal the rest of the day. The child received professional medical attention on April 23, 2024 for injuries to two fingers, as a result of the incident.
