591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs $299.00 and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.
During an investigation, it was determined that on September 22, 2020, a four-year-old child was left unsupervised in an empty and dark classroom for approximately three hours and staff were unaware that the child was missing. The four-year-old child arrived at the Center at approximately 8:00 a.m. The child was found sitting in the dark in their regular classroom when a staff member entered the classroom at approximately 11:30 a.m. to use the bathroom. Staff denied seeing the child with the group of children who were escorted to their classrooms or seeing the child walking alone after the parent dropped them off. The child has a known speech delay and was unable to call out for help or explain how they got into the classroom. The parent was notified of the incident at 2:30 p.m. No injuries were reported but professional medical treatment was obtained as a precaution. An enforcement fine was previously issued for this rule violation. This rule violation is no longer appealable.

591-1-1-.15(9) · Rule 591-1-1-.15(9) requires that when a child requires a modified diet for medical reasons, a written $499.00 statement from a medical authority shall be on file. When a child requires a modified diet for religious reasons, a written statement to that effect from the child’s Parent(s) shall be on file. All caregiver Personnel shall be informed of the diet restriction for the child and only food that complies with the prescribed dietary regimen but still meets the food and nutrition requirements shall be served to the child.
During an investigation, it was determined that on September 10, 2021, a four-year-old child, with known allergies to eggs and dairy, had an allergic reaction when given a cupcake during afternoon snack time which contained those products. Approximately one and a half hours later, the child vomited. Management brought the child to the front office, administered Benadryl per the child’s allergy plan, and notified the child’s parent. The parent, who was in the parking lot for pick up, observed the child to be hot to the touch and have a rash on the face. She administered an Epi-Pen. The child received professional medical treatment.
