    591-1-1-.03(9) · Rule 591-1-1-.03(9) requires staff shall not engage in or allow children or other adults to engage in activities that could be detrimental to a child’s health or well-being, such as but not limited to, horse play, rough play, wrestling, and picking up a child in a manner that could cause injury.

    During an investigation, it was determined that on April 17, 2025, at approximately 9:30 a.m., a 3-year- old child was removed from their designated classroom due to the child’s behavior. The 3-year-old child was allowed to assist a staff member with carrying infant car seats while in the front lobby. While attempting to carry an infant car seat, the child tripped and fell. The 3-year-old child was returned to their classroom. The child complained about arm pain and the child’s arm appeared to not look normal. The child was taken from the classroom by an administrator and given an ice pack. The staff member allowed the 3-year-old child to engage in an activity that was detrimental to the child’s health and safety, which resulted in an injury to the 3-year-old child’s left arm. The child required professional medical attention. The child sustained a fractured left arm as a result of the incident.

    During an investigation, it was determined that on April 17, 2025, at approximately 9:30 a.m., while in the front lobby with a staff member the 3-year-old child attempted to help carry an infant car seat, the child tripped, fell, and injured their left arm. The 3-year-old child returned to their classroom. The child began to complain about arm pain. The child was taken from the classroom by an administrator and given an ice pack. The 3-year-old child transitioned to naptime and when the child woke up, the child could not raise their left arm. The 3-year-old child then later transitioned to the playground. At approximately 3 p.m., another staff member notified the management that the 3-year-old child was experiencing pain in their left arm. According to statements, at approximately 4:19 p.m., the parents were notified of the child’s injury. The Department determined that the center failed to notify the child’s parent that the 3-year-old child cried from discomfort throughout the day due to the injury that occurred earlier during the day.

    During an investigation, it was determined that on April 17, 2025, the center failed to notify the Department of an incident with a 3-year-old child obtaining medical attention after an incident. On April 17, 2025, a 3- year-old child sustained a fractured left arm when attempting to carry an infant car seat. The center was informed of the 3-year-old obtaining medical treatment on April 17, 2025.
