591-1-1-.03(9) · Rule 591-1-1-.03(9) requires center staff to refrain from engaging in, or allowing children or other adults to engage in, activities that could be detrimental to a child's health or well-being, such as but not limited to, horse play, rough play, wrestling, and picking up a child in a manner that could cause injury.
During an investigation, it was determined that on May 12, 2025, children were allowed to swing inappropriately on the swing set resulting in an injury to a 3-year-old child. A review of video surveillance showed three 3-year-old children on the swing set, swinging on their stomachs. The 3-year-old child was observed to stand and twist the swing chains and then lie back on their stomach to spin around. The child then pushed off the ground and swung around, striking their head on the swing frame. The children were not redirected to swing on their bottom and not on their stomach, which resulted in the 3-year-old child sustaining a head injury that required professional medical attention. The child sustained a laceration to the forehead. Professional medical attention was obtained.

During a Complaint Investigation Follow Up conducted on December 14, 2022 ; It was determined based on observation the following hazards were accessible to children. 2nd Left Classroom- Rubber gloves and baby wipes that read "suffocation hazard" were located in the bottom of the unlocked diapering station. 3rd Right- Rubber gloves that read "suffocation hazard" were located on the diapering station. 2nd Right- Rubber gloves that read "suffocation hazard" were located on a shelf and a vacuum cleaner was left near the sink. 4th Left- Rubber gloves that read "suffocation hazard"were located on a shelf.

During a Monitoring Visit conducted on November 2, 2023 ; It was determined based on observation that the following hazards were accessible to children in care. Room D- 'Bath and Body Works' hand soap that read "keep out of reach of children" was located on the sink. Room F- A plunger was accessible in the restroom and adult scissors were on a shelf within the classroom. Room H- Baby wipes that read "suffocation hazard" were in the restroom. Room I- Baby wipes that read "suffocation hazard" were under the unlocked diapering station.

During a Complaint Closure conducted on March 16, 2023 ; It was determined that on February 7, 2023, at approximately 2:30 p.m., a two-year-old child was not properly supervised when a two-year-old child sustained multiple bite marks to the forehead, arm and finger, by a two-year-old child while playing in the classroom and center staff was unaware that the two-year-old child was being bitten. Professional medical attention was obtained. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

During an investigation, it was determined based on investigative findings that on November 16, 2021, at approximately 4:40 p.m., a two-year-old child sustained an injury to the finger after their finger was closed in a door. Three children were on the playground standing near the door. Staff directed the children to move away from the door but did not ensure that the children remained away from the door. The two-year-old child returned to the door and their finger was closed in the door. The staff did not provide watchful oversight in order to prevent the incident from occurring.

During an investigation, it was determined that the Director was informed that a two-year-old child required professional medical attention for an injury to the finger that occurred at the center on November 16, 2021. The director failed to report the medical attention to the Department within 24 hours as required.
