During a Complaint Investigation & Licensing Study POI Follow Up conducted on February 26, 2025 ; It was determined based on observation that Room C added a new diapering station that is across the room from the original and no diapering sink was adjacent.

Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm¶s length away from children thirty- six (36) months of age and younger.
During an Incident Investigation Closure conducted on October 9, 2024 ; It was determined based on an investigation, that on June 4, 2024, children were not adequately supervised when a 5-year-old child was pulled backwards by two other students and hit the back of their head on the floor in the school-aged classroom. The staff member was not alert to the activities of the children and was not aware of how the child was injured.

During a Monitoring Visit conducted on September 29, 2025 ; It was determined based on observation that in Room B an infant was drinking a bottle on the floor and the staff member was at the sink cleaning bottles with her back turned. Exhibit "A"

591-1-1-.03(9) · Rule 591-1-1-.03(9) requires center staff to refrain from engaging in, or allowing children to other adults to engage in, activities that could be detrimental to a child’s health or well-being, such as but not limited to, horse play, rough play, wrestling, and picking up a child in a manner that could cause injury.
During an investigation, it was determined that on April 16, 2024, staff members in the Toddler Classroom failed to intervene immediately to prevent an activity that was detrimental to the children’s health and well-being. Two one- year-old children stood on top of a kitchen play set for less than a minute, when one of the children was pushed from the play set, causing a right elbow injury. Staff members were aware of the children climbing and standing on top of the kitchen play set and failed to physically intervene to prevent harm or injury to the children while at the center. Professional medical attention was obtained, and the child sustained a fractured right elbow as a result of the incident. 2. 591-1-1-.11(2) requires that Personnel not: physically or sexually abuse a child or engage or permit others to engage in sexually overt conduct in the presence of any child enrolled in the Center; inflict corporal/physical punishment upon a child; shake, jerk, pinch or handle a child roughly; verbally abuse or humiliate a child which includes, but is not limited to, the use of threats, profanity or belittling remarks about a child or his family; isolate a child in a dark room, closet or unsupervised area; use mechanical or physical restraints or devices to discipline children; use medication to discipline or control children's behavior without written medical authorization issued by a licensed professional and given with the parent's written consent; restrict unreasonably a child from going to the bathroom; punish toileting accidents; force-feed a child or withhold feeding a child regularly scheduled meals and/or snacks; force or withhold naps; allow children to discipline or humiliate other children; or confine a child for disciplinary purposes to a swing, highchair, infant carrier, walker or jump seat. During an investigation, it was determined that on April 16, 2024, at 8:37 a.m., a staff member handled a child roughly when two children were standing on top of a kitchen playset and one child pushed another child off of the playset. Staff aggressively pulled a pacifier out of the mouth of the child that remained on the kitchen set and then grabbed the child by one arm to take them off the kitchen set as a form of discipline. The child was observed to hold their hand over their mouth and began to cry.

591-1-1-.07(2) · Rule 591-1-1-.07(2) requires that Parents be immediately notified and specific instructions obtained until the child can be picked up or returned to the group, immediately when professional medical attention is required, or when the child experiences symptoms of moderate discomfort, or when the child is involved in an incident that puts their health and/or safety at risk and to notify Parents by the end of the day when professional medical attention is not required, when the child experiences symptoms of less than moderate discomfort or when the child experiences an adverse reaction to prescribe medication which does not constitute moderate discomfort.
During an investigation, it was determined that on April 16, 2024, at 8:37 a.m., a one-year-old child fell from a kitchen play set and injured their right elbow. While at the center, the child showed signs of moderate discomfort throughout the day after falling from the kitchen play set. One staff member reported to management staff that the child was crying a lot throughout the day. The child’s parents were notified of the child’s discomfort after 4:30 p.m. The center failed to notify the child’s parents immediately once the child experienced symptoms of moderate discomfort as required by the Department.

During an investigation, it was determined that on April 16, 2024, at 8:37 a.m., a one-year-old child fell from a kitchen play set and injured their right elbow. The child showed signs of discomfort and staff asked the child if something was wrong with their arm. The child continued to cry off and on throughout the day. Staff did not alert the center director or the child’s parent of the fall and did not take measures to make the child comfortable.

It was determined based on an investigation, that on March 20, 2024, there was less than an inch of resilient surface under the swings, when a two-year-old child fell from the swing. The child sustained two chipped teeth, due to the fall.

591-1-1-.12(1) · Rule 591-1-1-.12(1) requires all indoor and outdoor furniture, activity materials, and equipment shall be used in a safe and appropriate manner by each Employee and child in attendance and in accordance with the manufacturer's instructions, recommendations, and intended use. All equipment and furniture shall be used only by the age-appropriate group of children.
It was determined based on an investigation, that on March 20, 2024, a two-year-old child swung on a swing on their stomach, which is not a recommended use of the swing. The child fell from the swing and sustained two chipped teeth.

591-1-1-.29(3) · Rule 591-1-1-.29(3) requires the Director or designated person-in-charge shall report or cause to be reported to the Department within twenty-four (24) hours or the next work day: any death of a child while in the care of the Center; any serious illness or injury requiring hospitalization or professional medical attention other than first aid of a child while in the care of the Center; any situation when a child in care becomes missing, such as, but not limited to, a child who is left on a vehicle, a child who leaves the building, playground, or property, or a child who is left behind on any trip; any fire; any structural disaster; any emergency situation that requires temporarily relocating children; and any time the program’s operating status changes (i.e., open to closed or temporarily closed and temporarily closed to open).
It was determined that on March 20, 2024, at 9:48 a.m., a two-year-old child sustained two chipped teeth after falling from a swing on the toddler playground. The center was notified on March 27, 2024, that the child received professional medical attention on March 22, 2024, for the injury. The center failed to report the incident to the department within 24 hours, or the next working day, that professional medical attention was received.

No staff were seated within an arm¶s length from the one-year-old during meal time. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

The staff member prepared bottles in another area of the room and was not seated within arm's length from the child. An adverse action was previously issued for this rule violation. During a Complaint Investigation & Monitoring Visit POI Follow Up conducted on February 1, 2023 ; It was determined based on observation that upon arrival to the center a staff member had a crying child in the hallway, the staff member left the child with another staff member while coming to open the door for consultant. The staff member who was providing supervision for the child walked into a classroom for a brief moment and the child was left in the hallway unsupervised. It was further observed that a child in the Room I (3L) walked out of the room for a brief moment into the hall and the staff member came to the door to bring the child back in. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

It was further determined that a staff member in the 1R Classroom entered the center for the day, attended circle time, and cleaned two children's noses without washing her hands. In addition, a staff member in the 1R Classroom did not wash their hands before or after diapering.

591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm¶s length away from children thirty- six (36) months of age and younger.
During a Licensing Study conducted on May 24, 2022 ; It was determined based on observation that a one-year-old in the 1L classroom was eating at the table while one staff member walked around the classroom and the other staff member was in the circle time area. No staff were seated within an arm¶s length from the one-year-old during meal time.

During a Complaint Closure conducted on January 2, 2023 ; It was determined based on investigative findings that on December 9, 2022 center staff failed to provide watchful oversight while two staff members braided hair with children present in the classroom and awake. It was further determined that on December 9, 2022 a nine-month-old infant was given a bottle for feeding. The staff member prepared bottles in another area of the room and was not seated within arm's length from the child. Exhibit "A"
