    591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in- Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.

    During an investigation, it was determined that on August 2, 2023, watchful oversight was not provided when a three-year-old child was dropped off at an elementary school unsupervised for approximately 30 minutes. 3. 591-1-1-.36(6) requires written Parental authorization for routine transportation provided by or on behalf of the Center. Written authorization must include the routine pick-up location, routine pick-up time, routine delivery location, routine delivery times and the name of any person authorized to receive the child. During an investigation, it was determined that on August 2, 2023, center staff failed to ensure parental authorization was obtained when it was stated that a three-year-old child was dropped off at a location that was not authorized by the child’s parent. 4. 591-1-1-.36(9) requires the Center to be responsible for the child from the time and place the child is picked up until the child is delivered to his or her Parent(s) or responsible person designated by Parent(s). A child shall not be dropped off at any location where there is no one present authorized to receive the child. During an investigation, it was determined that on August 2, 2023, center staff failed to assume responsibility for a three-year-old child when the child was dropped off at an elementary school.

Two staff members were seated in chairs in an area that was away from the equipment. One staff member stated they saw the child fall once and called the child over to check the child. The child returned to the equipment and fell a second time, which was not observed by either staff member. Other children alerted the staff members that the five-year-old child was crying. A staff member told the children to bring the child to them. The child walked over to where the two staff members were seated. The child informed the staff members that their arm was hurting. Professional medical attention was required.
