During an investigation, it was determined that on September 23, 2025, adequate supervision was not provided when a 1-year-old child with a milk allergy ingested cow’s milk from another child’s cup during breakfast. Staff members were unaware that the child had ingested milk from the other cup until after the child displayed multiple signs of an adverse reaction throughout the morning. It was further determined that staff members in the classroom were not sitting within an arm’s length away from the children during breakfast. The 1-year-old child received professional medical attention for the allergic reaction.

During an investigation, it was determined that on March 19, 2025, center staff failed to provide watchful oversight when an unsecured bookshelf in the classroom fell on top of a 2-year-old child. At the time of the incident, there were two teachers present in the classroom with 17 children. The 2-year-old child walked behind a rolling bookshelf with two other children and placed their hands on top. The bookshelf instantly fell on top of the child, and the child began to cry. The child obtained professional medical attention for a fractured left foot and leg. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

During a Complaint Closure conducted on October 27, 2025, it was determined based on an investigation that on September 16, 2025, and September 24, 2025, a 4-year-old child was injured while in care. On September 16, 2025, the 4-year-old child sustained swelling on the left side of their forehead and a small scratch on their nose. On September 24, 2025, the 4-year-old child sustained swelling to the middle of the forehead. The staff did not provide adequate supervision when they were unaware of when or how the 4-year-old child was injured. Professional medical attention was obtained as a precaution. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

During an Incident Investigation Closure conducted on May 9, 2025 ; It was determined based on an investigation that on March 19, 2025, at approximately 9:37 a.m., the center staff failed to provide watchful oversight when a 2-year-old child climbed on a rolling bookshelf in the 2 L-900 Penguins classroom. The center staff cleaned the classroom and prepared to transition the class outside, while their backs were turned to the child that was positioned behind a rolling bookshelf. The child attempted to climb the rolling bookshelf, causing the bookshelf to fall on their left leg. The center staff turned around when they were alerted by the child¶s cry and the sound of the bookshelf falling on the child. As required by the Department, the center staff were not strategically positioned to see all of the children and the spaces they occupied to prevent harm and injury. As a result of the incident, the child required professional medical attention and was diagnosed with a fractured left foot and leg. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

During an investigation, it was determined that on March 19, 2025, at approximately 9:37 a.m., the center staff failed to provide watchful oversight when an unsecured bookshelf in the classroom fell on top of the child. At the time of the incident, there were two teachers present in the classroom with 17 children. Video footage showed the 2- year-old child was positioned on the floor to the left of the red bookshelf initially, while the teachers cleaned the classroom from breakfast. The children were scattered throughout the classroom playing with toys. Staff member A proceeded to walk to the back of the classroom, as the 2-year-old child walked behind the teacher. Staff member B continued cleaning the classroom, while engaging the children at the front of the classroom. Staff member A then placed a wooden toy block on a rolling yellow bookshelf that was positioned near the exit door. Staff member A bent down, and the 2-year-old child walked to the left of the teacher and behind the rolling yellow bookshelf with the two other children. Staff member B was positioned to the left front of the classroom assisting children at the sink while washing their hands. Staff member A began to walk back towards the front of the classroom and the child placed their hands on the rolling yellow bookshelf when it instantly fell on top of the child. At time, staff member B turned towards the rolling yellow bookshelf as they were attempting to put on another child's shoes. The 2-year-old child started to cry after the bookshelf fell. Staff failed to actively supervise and provide watchful oversight to the child while at the center which resulted in the rolling yellow bookshelf falling on top of the child. The child required professional medical attention and, the child sustained a fractured left foot and leg.

During an investigation, it was determined that center staff failed to secure equipment on March 19, 2025, at approximately 9:37 a.m. when an unsecured rolling shelf fell onto a 2-year-old child. The child placed their hands on the rolling yellow bookshelf when it instantly fell on top of the child. The center failed to properly secure the shelf equipment to prevent the equipment from tipping over and causing an injury to a 2-year-old child. The child required professional medical attention and, the child sustained a fractured left foot and leg.

During an investigation, it was determined that on July 1, 2022, a ten-year-old child was injured while playing kickball on the playground. The third base had been set up in front of the swing set and as he was running to the base a child that was swinging kicked him in the mouth. There were two staff members present and 18 children. However, neither of the staff witnessed the accident or realized that a kickball game had been set up in front of the swing set. Medical attention was received, and the child was diagnosed with avulsion of the teeth.
