During a Licensing Study conducted on May 16, 2024 ; It was determined based on observation, the fence was observed to be in need of repair in the following areas: - The gate between the 1st and 2nd building was observed to be detached from the pole and a large gap was observed at the top. - The gate on the inner barrier fence was observed to be detached from the pole between the 3rd Left and back middle playgrounds. - The wooden fence on the back center playground was observed to be in need of repair. - Multiple wooden boards were observed to be missing on the left side of the middle playground.

During a Licensing Study conducted on April 9, 2025 ; It was determined based on observation, that the following areas were observed to be in need of repair: 1st Left Playground: Two gaps were observed located in the fence. One 9 1/2 inches and one 3 1/2 inches. Back Middle Playground: A very large gap from apparent tree falling through from neighbor's property. The fence poles and wire were observed to be bent, exposing sharp areas.

During a Licensing Study conducted on May 16, 2024 ; It was determined based on observation, the following areas were observed to be in need of repair. 1st Right Playground- 1 of 4 tires were observed to be dry rotted on the yellow car and 2 play cars were observed to have broken wheels and multiple broken toys were observed. Exposed tree roots were observed throughout the outside playground and multiple swings were observed to be worn and cracked. A red rubber mat was observed on the back center playground, causing a potential tripping hazard.

During a Licensing Study conducted on April 9, 2025 ; It was determined based on observation that the following hazards were present in the outdoor playgrounds, Left Playground: A cracked and broken plastic cover was observed to be hazardous on the turf area. Further, in the same area, one of the yellow swings was observed to be cracked and the wood located on the preschool deck was filled with rotten wood. Center Playground: A hole was observed to be in the raised platform and rotten wood was on threshold before turf. Further, two swing sets were observed to be broken and one had fallen. Right Playground: A large hole was observed at the bottom of the deck, two nails were protruding and a metal plate between the wood in the fence was present on the wooden deck and and on ground before the turf area.

During an investigation, it was determined that on June 4, 2024, center staff did not maintain the required Staff:child ratio when a single staff member supervised a group of 22 children to include three four-year-olds, eight five-year-olds, and 11 school age children on the playground. At least two staff members were required for the group of 22 children.

Staff were not providing watchful oversight to prevent the injury from occurring. The child received professional medical attention.

During an investigation, it was determined that on January 25, 2024, at approximately 11:35 a.m., staff failed to provide watchful oversight when a four-year-old child sustained a gash on their chin when they were hit with a toy by another child. Center staff failed to properly position themselves in the classroom to be able to see and respond to the actions of all of the children to prevent the incident from occurring. Staff were unaware that the incident occurred until other children informed them. Professional medical attention was obtained.

During an investigation, it was determined that on October 12, 2022, the center staff roughly handled a one-year- old child which caused the child to stop breathing. The video footage revealed that there were two center staff, and five children present while in the classroom. At approximately 9:05 a.m., center staff A was observed lifting one child by the arm out of a bouncy chair and another child that was in a crib by the arm and placed them on the floor. Center staff A was observed to get down in the injured one-year-old child’s face, talk harshly to the one-year-old child and then forcefully pick him up and place him roughly into a bouncy chair. Video surveillance further revealed staff member A grabbed the injured one-year-old child by the arm and stood the one-year-old child up in a standing position to try to get him to walk. Center staff A was standing in the view of the camera, the injured one-year-old child could not be seen. The one-year-old child fell to the floor and began to cry inconsolably. Center staff A turned around and walked away from the one-year-old child. The one-year-old child began to show signs of distress. Center staff B administered first aid to the child and reported the incident to the administrators. The administrators called 911 and the child’s mother.
