591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.
During an investigation, it was determined that on November 11, 2024, at approximately 9:00 a.m., center staff failed to provide adequate supervision when a three-year-old child sustained multiple scratches during a physical altercation with another child. While the children were sitting on the carpet in the Three-Year-Old Classroom, the staff were engaged in conversation and distracted by a tablet, unaware of the fight. Center staff were not alert or positioned to maximize their ability to hear and see the children to prevent harm or injury to the children as required by the Department. The child required professional medical treatment.

During an investigation, it was determined that on November 11, 2024, at approximately 8:48 a.m., a teacher roughly handled a three-year-old child who was crawling under a table, pulling them by one arm and sliding them abruptly to the side. At 8:57 a.m., the same teacher roughly handled the child again after a physical altercation with another child, pulling, grabbing, and pushing the child during separation. The staff member aggressively grabbed the child by the forearms, forced them to sit on their leg, and then placed the child roughly on the floor, causing the child to cry. The staff member’s actions violated Department guidelines against rough handling.

591-1-1-.03(9) · Rule 591-1-1-.03(9) requires center staff to refrain from engaging in, or allowing children or other adults to engage in, activities that could be detrimental to a child's health or well-being, such as but not limited to, horse play, rough play, wrestling, and picking up a child in a manner that could cause injury.
During an investigation, it was determined that on November 11, 2024, at approximately 8:44 a.m., a three-year- old child was allowed to crawl underneath a table where other children were sitting and eating breakfast. The child crawled around underneath the table for approximately six minutes while they grabbed at the other children. The other children were observed to kick at the child and move their chairs back and forth under the table. The staff member was aware that the child was under the table and allowed the child to continue the activity without redirecting the child or removing them from underneath the table.
