It was further determined that in the 2nd Right Class that 2-year-old children were eating and the staff member was not seated and was standing behind the children.

During a Complaint Investigation Follow Up conducted on April 30, 2026 ; It was determined based on observation that in the 1st Right Classroom 1-year-old children were eating breakfast and both staff in the room were standing and serving. It was further determined that in the 2nd Right Classroom a 2- year-old had milk and the staff was not seated within arm's length, and the class was later provided breakfast and one staff member was seated and not within arm's length of all children eating. In addition, the staff member in the Media Room was sitting at the table on her personal phone when consultant arrived at the room. Exhibit "A"

During an investigation, it was determined that on January 29, 2024, center staff failed to provide watchful oversight when staff members were not aware of where the child was and what they were doing at all times. This resulted in a one-year-old child sustaining an injury to the left middle finger, due to a rocking chair being rocked over the child’s finger. Professional medical attention was received.

During a Complaint Investigation Follow-Up conducted on April 12, 2023, it was determined based on investigative findings that center staff failed to provide watchful oversight on April 10, 2023, at 3:00 p.m. when a two-year-old child sustained a hand injury when a staff member closed their left hand in a classroom door. The teacher was observed on surveillance footage answering their cell phone in the classroom. The teacher stepped out of the back door to talk on the phone, leaving the children in the class unattended. After several minutes, the children gathered at the door where the teacher was standing and the teacher redirected the children to go back inside on two occasions. Upon reentering the classroom, the teacher did not ensure the doorway was clear of children and closed the door on the child's hand. Professional medical attention was obtained. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.
