591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the childcare area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participate with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.
During an investigation, it was determined that on March 5, 2026, at approximately 8:45 a.m. staff failed to provide watchful oversight when a 1-year-old child was grabbed by the face and bitten on the left cheek by another child. The child sustained a scratch to the right side of the face, several scratches to the left side of the face, and three bites to the left cheek that broke the skin. A staff member was talking to a parent and heard the 1-year-old child scream. When the staff member went to the child, they found another child positioned on top of the 1-year-old child, actively biting the child on the left cheek and scratching the child on the right side of the face. The child received professional medical treatment for a human bite to the face. Staff members were not positioned to actively observe all children.

During a Licensing Study conducted on October 15, 2025, it was determined based on observation that in the 1st Right Classroom, a 1-year-old child was provided breakfast, and the staff member was not seated within arm’s length of the child for the entire mealtime.

591-1-1-.03(9) · Rule 591-1-1-.03(9) requires staff shall not engage in, or allow children or other adults to engage in, activities that could be detrimental to a child’s health or well-being, such as but not limited to, horse play, rough play, wrestling, and picking up a child in a manner that could cause injury.
During an investigation, it was determined that on April 3, 2024, at 12:30 p.m., a non-verbal six-year-old child was injured due to the responsible staff person allowing children to participate in rough play activities while in the classroom. Video footage revealed the children were playing in a rough manner as the staff person sat nearby, watching the children’s interactions. The staff person did not redirect the children or intervene to stop the inappropriate rough play activity. During the rough play, a child stepped on the hand of the six-year-old child, resulting in an injury to the child’s left hand. The six-year-old child expressed signs of distress by crying and holding their hand along with rolling on the floor as the staff person sat nearby observing the children’s interactions. An older school-aged child walked over and picked up the six-year-old child and comforted the child. The six-year-old child later walked to the staff person and showed their injured hand to the staff person. The staff person contacted administrative staff regarding the incident, the administrative staff made multiple attempts to contact the child’s parent. The six-year-old child obtained professional medical attention for a hand injury.

591-1-1-.03(8) · Rule 591-1-1-.03(8) requires individual attention. Personnel shall provide individual attention to each child. Examples include but are not limited to responding promptly to the child’s distress signals and need for comfort; playing with and talking to the children; and providing and assisting the child with personal care in a manner appropriate to the child’s age level, i.e., providing the child privacy in dressing, diapering and toileting functions as the developmental age of the child dictates.
During an investigation, it was determined that on April 3, 2024, at 12:30 p.m., a non-verbal six-year-old child was injured when their left hand was stepped on while in the classroom. Video footage showed children engaging in horse play and stepping on the child's hand while in the classroom. The staff person did not respond to the child’s signs of distress, as the child was crying and holding their arm/hand. The staff person appeared to be watching the children participate with rough play, however the staff person did not intervene to physically separate the children or redirect the children’s behavior. A school age child attempted to comfort the non-verbal six-year-old child after the incident. The non-verbal six-year-old child obtained medical attention, for a hand injury.

During an investigation, it was determined that on March 1, 2024, at 9:35 a.m., a two-year-old child was injured when their left index finger was caught in the door frame. There were two staff members and 16 two-year-old children in the classroom. According to video footage, the two-year-old child was observed standing near the restroom door. When transitioning the additional children from the restroom, another child closed the restroom door as the two-year-old child placed their finger in the restroom door frame. The child screamed out and staff assisted the child by removing the child’s hand, providing first aid, and notifying management of the incident. The two-year-old child sustained an injury to the index finger of the left hand. The child received professional medical attention.

During a Licensing Study on July 17, 2023, it was determined based on observation that a child was in the director's office and the director stepped out into the lobby area, leaving the child unsupervised. It was further determined that in the 1st Right Classroom, one-year-old children were eating at the table and one staff member was at the carpet area and the other staff member walked to the cubby to fix a bow in a child's hair. The designated area was not within arm’s length of the children.
