It was further determined that the cracked area of the tunnel had sharp edges that exposed the inside of the equipment.

    During an Incident Investigation Closure conducted on December 6, 2022 ; It was determined based on an investigation that on April 21, 2022, a four-year-old child sustained a broken arm when the child attempted to grab a pole attached to the outdoor playground equipment. The child had to locate a staff member to make them aware that the incident had occurred. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

    During an Incident Investigation conducted on May 10, 2022, it was determined that on April 21, 2022, staff did not account for a four-year-old child while on the playground. According to staff statements, and supporting evidence, the four-year-old child was not provided watchful oversight for an undetermined amount of time when using outdoor climbing equipment. The child was observed on video surveillance to slide down the slide once and attempt it a second time, but the child stood up and can be observed falling to the ground. The child is then observed to walk to the staff member who then examined the child. The Department determined that the staff member did not provide adequate supervision or watchful oversight when the child was injured. The Consultant also observed several instances on the playground's video surveillance where the staff members did not provide adequate watchful oversight and supervision. A lot of the children were behind a wall which created a blind spot for the staff members. Consultant also observed the staff members observing the children using the equipment in an inappropriate and unsafe manner and they did not re-direct the children.

    During an Incident Investigation conducted on May 10, 2022, it was determined that on April 21, 2022, the center had an inadequate amount of resilient surfacing underneath the climbing unit measuring at one to two inches. Center staff failed to ensure that the resilient surfacing measured at six inches for the outdoor play equipment. The four-year-old child sustained a fractured left elbow after falling on the inadequately maintained resilient surface.
