591-1-1-.03(9) · Rule 591-1-1-.03(9) requires that staff shall not engage in, or allow children or other adults to engage in, activities that could be detrimental to a child’s health or well-being, such as but not limited to, horse play, rough play, wrestling, and picking up a child in a manner that could cause injury.
During an Incident Investigation and Follow-Up visit conducted on February 19, 2025, it was determined based on an investigation that on January 31, 2025, a staff member roughly handled a 3-year-old child by picking them up by the arm causing an injury to the elbow. The staff member was moving the child from one area of the room to another when the incident occurred. The staff member was observed swinging the child’s arm back and forth while walking toward the other children. The child was observed crying and holding their right arm. The injury required professional medical attention.

During a Complaint Investigation and Follow-Up Visit conducted on June 7, 2024, it was determined based on an investigation that on May 16, 2024, a staff member handled a two-year-old child in a manner that resulted in three fingernail marks being left on the child's right forearm. The staff member was attempting to redirect the child from a muddy area when the incident occurred.

During an investigation, it was determined that on March 15, 2022, a two-year-old child sustained a serious arm injury when staff persons picked the child up in a manner that resulted in injury. Video footage showed a staff person pick the child up by the left arm on the way to the bathroom. Shortly thereafter, while the child was on the floor, a second staff person, who was seated in a chair, pulled the child by the left arm, and then assisted the child to a standing position, holding just the left arm. The child was observed to be crying and holding their left arm in a position that indicated discomfort. The child’s parent was notified at 11:00 a.m. and was told there was no visible injury. The parent requested they apply ice and to call again if the child continued to complain. The child ate lunch and slept at nap time. The child woke up crying. The child’s parent was called again at 2:45 p.m. The child received professional medical treatment and was diagnosed with Nursemaid’s Elbow.
