    591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.

    During an investigation, it was determined that on August 8, 2025, at approximately 2:07 p.m., a 2-year-old child was not properly supervised and ingested 7-Hydroxymitragynine, a compound derived from Mitra Gyna Speciosa (Kratom). As a result, the child became lethargic, was unable to maintain balance, and had difficulty holding up their head. Emergency services were contacted and when they arrived, they administered a dose of Narcan to the 2- year-old child prior to transporting the child to the hospital for additional medical treatment. 2. Rule 591-1-1-.31(13) prohibits Center Staff from committing any criminal act, as defined under Georgia law, in the presence of any child enrolled in the Center and requires Center staff to comply with all applicable laws and regulations. During an investigation, it was determined that on August 8, 2025, at approximately 2:07 p.m., a staff member had an over the counter medication in their possession while in the classroom. 7-Hydroxymitragynine, a compound derived from Mitra Gyna Speciosa (Kratom). A 2-year-old child ingested the substance and subsequently became lethargic. The staff member was arrested and charged with Cruelty to Children in the 2nd Degree .

    During an investigation, it was determined that on August 8, 2025, at approximately 2:07 p.m., staff failed to keep hazardous materials out of the reach of children when a 2-year-old child ingested 7-Hydroxymitragynine, a compound derived from Mitra Gyna Speciosa (Kratom) that was stored on top of classroom cubbies. At an undetermined time, the pill fell to the floor and the child picked it up and ingested it. Professional medical attention was received. .
