During an investigation, it was determined that on September 25, 2023, a five-year-old child sustained an injury to their arm when children were allowed to engage in rough play. Several children were observed to be engaged in rough play throughout the classroom. As a result of the rough play a five-year-old child was pulled by the leg and the arm by two other children and sustained a serious arm injury which required medical attention.

591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be superviseda t all times appropriate to the individual age, needs and capabilities of each. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. “Supervision” means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. During an investigation, it was determined that on September 25, 2023, a five-year-old child sustained an injury to their arm when a staff member did not provide watchful oversight while in the classroom due to using their cell phone for several minutes. Investigative findings indicated that while the staff member was using their cell phone two children pulled the arm and the leg of a five-year-old child resulting in the child sustaining a serious injury to their arm, which required medical attention.
