591-1-1-.03(9) · Rule 591-1-1-.03(9) requires center staff to refrain from engaging in, or allowing children or other adults to engage in, activities that could be detrimental to a child's health or well-being, such as but not limited to, horse play, rough play, wrestling, and picking up a child in a manner that could cause injury.

It was determined based on an investigation, that on January 26, 2024, at approximately 4:50 pm., while in the cafeteria, center staff allowed a child to engage in activities that were detrimental to the health and well-being of the five-year-old child in care. The staff members folded two tables in an upright position and tied a string from one table to the other table to act as a net for the children to play a game of balloon volleyball. The five- year-old child walked over to the table and stepped on the railing under the table causing it to fall on top of the child. The five-year-old child sustained several injuries that required professional medical treatment.

591-1-1-.12(1) · Rule 591-1-1-.12(1) requires each Employee and child in attendance to use all indoor and outdoor furniture, activity materials, and equipment in a safe and appropriate manner and in accordance with the manufacturer's instructions, recommendations, and intended use. All equipment and furniture shall be used only by the age-appropriate group of children.
