591-1-1-.21(3) · Rule 591-1-1-.21(3) requires that the Center conduct drills for fire, tornado and other emergency situations. The fire drills will be conducted monthly and tornado and other emergency situation drills will be conducted every six months. The Center shall maintain documentation of the dates and times of these drills for two years.

During a Licensing Study conducted on August 30, 2022 ; It was determined based upon a review of records that the center failed to conduct tornado drills and lock down drills every six months as required by the department.

During a Monitoring Visit conducted on February 21, 2023 ; It was determined based upon a review of records that the center failed to conduct tornado drills and lock down drills every six months as required by the department. Provider could not provide evidence to show that tornado drills and lock down drills were conducted every six month as required by the department.

591-1-1-.26(4) · Rule 591-1-1-.26(4) requires that playgrounds be protected from traffic or other hazards by a (4) four foot high fence or other barrier approved by this Department. Fencing material shall not present a hazard to children and shall be maintained so as to prevent children from leaving the playground area by any means other than through an approved access route. Fence gates shall be kept closed except when persons are entering or exiting the area.

During a Monitoring Visit conducted on May 19, 2022 ; It was determined based on observation that there were three large holes that posed a potential entrapment hazard along the bottom of the back side of the fence.

During a Monitoring Visit conducted on February 21, 2023 ; It was determined based on consultant's observation that there were approximately four bolts facing inward that had more than two or three threads facing the inside of the playground.

In order for the file to be complete, the file shall contain the following: child¶s name, birth date, sex, address, living arrangement, name of school if applicable; names of both Parents, home and work addresses, and home and work telephone numbers; name(s) and addresses of the person(s) to whom the child may be released including address, telephone numbers, relationship to child and to Parent(s), and other identifying information; name(s) and telephone number(s) of person(s) to contact in emergencies when the Parent cannot be reached; name and telephone number of the child¶s primary source of health care; and a statement regarding known allergies, physical problems, mental health disorders, mental retardation or developmental disabilities which limit the child¶s participation in the program.

During a Licensing Study conducted on August 30, 2022 ; It was determined based upon a review of records that center staff failed to provide the consultant with children's files during an administrative review.

During a Licensing Study conducted on August 30, 2022 ; It was determined based upon observation that there were thorny vines on the back of the right side fence.

During a Monitoring Visit conducted on February 21, 2023 ; It was determined based on consultant's observation that an active ant bed was present of the playground. It was further determined that two lawn mowers were present on the playground, which were secured with a loose gray security rope. It was also determined that there was a large industrial rubber band laying, on the ground, adjacent to the two lawn mowers. Exhibit "A"
