591-1-1-.03(9) · Rule 591-1-1-.03(9) requires staff shall not engage in, or allow children or other adults to engage in, activities that could be detrimental to a child’s health or well-being, such as but not limited to, horse play, rough play, wrestling, and picking up a child in a manner that could cause injury.
During a complaint investigation and follow-up visit conducted on March 19, 2025, it was determined based on an investigation that on March 14, 2025, staff members redirected a 2-year-old child, verbally, multiple times for running. The child continued to run around the room and around the table in the classroom. Staff did not physically intervene to stop the child from running. Another child stood up from the table and the 2-year-old child tripped over their feet and hit their face on the floor. The child sustained an injury to the upper lip. The injury required professional medical attention.

The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in- Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.
During a Complaint Closure conducted on December 13, 2024, it was determined based on investigative findings, that on September 11, 2024, a four-year-old child sustained a cut on their forehead after they were hit with a broom by another child. The child was not supervised by center staff for up to 15 minutes.

During an investigation, it was determined that on May 16, 2024, children were not adequately supervised when a three-year-old child exited the center unnoticed by staff persons and was found by a passerby. At approximately 4:09 p.m., the three and four-year-old children were combined with the school aged children. At the time of the incident, there were classes combined and a ratio of one staff person and 24 children. The staff person was intervening in an altercation between two children. The staff person had no knowledge that the three-year-old child entered or exited the classroom. Center management conducted a routine check and realized that the three-year-old child was missing. While searching for the three-year-old child, a staff person from the afternoon bus route entered the center from the parking lot through the back door. When that staff person reached the front lobby, an unknown adult was outside the front door with the missing three-year-old child. The unknown individual reported that the three-year-old child was in front of the center, however, did not specify the child’s exact location. The child was unharmed and returned to their classroom at approximately 4:30 p.m., the child was not supervised for approximately 15 minutes.

During an investigation, it was determined that on May 16, 2024, at approximately 4:09 p.m., there was one staff person with 24 children, ages three years old to school aged.
