    591-1-1-.26(8) · Rule 591-1-1-.26(8) requires climbing and swinging equipment to have a resilient surface beneath the equipment and the fall zone from such equipment must be adequately maintained by the Center to assure continuing resiliency.

    During a Complaint Investigation & Monitoring Visit conducted on February 1, 2023 ; It was determined based on observation that the resilient surfacing on playground PG/A/Upper measured approximately three inches at the green and red pull up bars. Six inches of resilient surfacing was required.

B/R side 2R - Rusted vents were observed on the left side near the music/manipulative area. - Peeling paint was observed on the right wall in black/art area.

    During a Licensing Study conducted on October 7, 2022 ; It was determined based on observation that the following hazards were observed on the playground: - Litter was observed on the PG/A/Upper, PG/B/Concrete, and PG/C/Lower playgrounds. PG/C/Lower playground - Ladder, water hose, discarded wood, and a broken table were observed under the shed. - Active ant pile was observed near the entrance gate. - Exposed cords on the left side of the building.

Consultant discussed with the Director removing the tree limbs from all the playground areas.

    591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm¶s length away from children thirty- six (36) months of age and younger.

    During a Licensing Study conducted on October 7, 2022 ; It was determined based on observation that a staff member was observed responsible for classroom A/ R side/ 1R and classroom B/ R side/ 2R on this date. The staff member was observed supervising both classrooms during center time for approximately five minutes before combining the classes into classroom B/ R side/ 2R.

It was further determined that a one-year-old child was unsupervised when they walked into classroom D/L side/1L for approximately two minutes. Exhibit "A"
