591-1-1-.11(2) · Rule 591-1-1-.11(2) requires that personnel shall not: physically or sexually abuse a child or engage or permit others to engage in sexually overt conduct in the presence of any child enrolled in the Center; inflict corporal/physical punishment upon a child; shake, jerk, pinch or handle a child roughly; verbally abuse or humiliate a child which includes, but is not limited to, the use of threats, profanity or belittling remarks about a child or his family; isolate a child in a dark room, closet or unsupervised area; use mechanical or physical restraints or devices to discipline children; use medication to discipline or control children's behavior without written medical authorization issued by a licensed professional and given with the parent's written consent; restrict unreasonably a child from going to the bathroom; punish toileting accidents; force-feed a child or withhold feeding a child regularly scheduled meals and/or snacks; force or withhold naps; allow children to discipline or humiliate other children; or confine a child for disciplinary purposes to a swing, highchair, infant carrier, walker or jump seat.
It was determined based on an investigation that on March 16, 2026, at approximately 12 p.m., a 1-year-old child was disciplined inappropriately by a staff member. The child began kicking and screaming during lunch, and the staff member then picked the child up, forcefully slamming them onto their cot and yanking their bib off from around their neck. After the incident occurred another staff member observed a bruise by the child’s left eye. Professional medical attention was received. 2. Rule 591-1-1-.31(13) prohibits Center Staff from committing any criminal act, as defined under Georgia law, in the presence of any child enrolled in the Center and requires Center staff to comply with all applicable laws and regulations. It was determined based on an investigation that on March 16, 2026, at approximately 12 p.m., a staff member inappropriately disciplined a 1-year-old child which resulted in a bruise to the left eye. The staff member was arrested on March 18, 2026, and charged with simple battery.

It was determined based on an investigation that on February 27, 2025, a staff member struck a 4-year-old child with a tablet, on their leg, as a form of discipline after the child kicked at the staff member. In addition, on March 18, 2025, another staff member inappropriately disciplined a one-year-old child by striking the child on the back of the hand four times after the child pulled paper off of the bulletin board located next to the child’s crib. During an Incident Investigation Closure conducted on December 3, 2025 ; It was determined based on an investigation that on November 12, 2025, at approximately 8:25 a.m., adequate supervision was not provided when a 2-year-old child was injured after being struck in the face by a toy truck. Another child was spinning in circles, swinging the toy truck, and struck the 2-year-old child in the face. Neither staff member in the classroom observed the incident, as one staff member was cleaning while the other staff member was completing paperwork with their back turned to the children. The 2-year-old child obtained professional medical attention for a cut under their eye. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

During an Incident Investigation & Follow Up conducted on December 29, 2025 ; It was determined based on observation that staff were not seated arm's length away during mealtime from five 2-year-old children in Main F-6th Right- 2 y/o. The staff to child ratio was 2:11. One staff was placing cots on the floor, assisted a child who was laid on the cot, and then moved to sit at the table with six children. The other staff was standing at the sink and remained there. Exhibit "A"

Based on an investigation, it was determined that on November 12, 2025, at approximately 8:25 a.m., children were not adequately supervised when a 2-year-old child was hit with a toy truck by another child, resulting in a cut underneath the eye. There were two staff members present in a classroom with eleven 2-year-old children. At the time of the incident, one staff member was cleaning tables on the left side of the classroom, and the second staff member was standing near the carpeted play area completing paperwork. The second staff member had their back towards the children. The children were located at the carpeted play area. One child turned in circles and swung a toy truck while other children played nearby with trucks on the carpet. The 2-year-old child was crawling while rolling a truck and was struck in the face by the child swinging their truck. The child began to cry, and the second staff member turned around and asked the children what happened. The 2-year-old child received professional medical attention for a cut underneath the right eye due to the incident. The staff members were not positioned to maximize their ability to hear and see the children at all times.

591-1-1-.03(9) · Rule 591-1-1-.03(9) requires staff shall not engage in or allow children or other adults to engage in activities that could be detrimental to a child’s health or well-being, such as but not limited to, horse play, rough play, wrestling, and picking up a child in a manner that could cause injury.
During an investigation, it was determined that on May 20, 2025, a staff member clipped a 1-year-old child’s nail too closely, cut the skin, and caused bleeding. There were two staff members, and 14 children, in the classroom. Staff statements indicated that the staff member moved the 1-year-old child to the sink area and placed the child’s finger under running water, to stop the bleeding. The staff contacted the center administrators and the child’s parent of the incident. The center contacted emergency services after being unable to stop the bleeding, and the child was treated and received professional medical treatment. The staff did not receive approval from the child’s parents before using the nail clippers, this activity was detrimental to the child’s health and well-being.

During an investigation, it was determined that on May 19, 2025, two children were observed walking up the slide equipment with a large toy within an 11-minute timeframe. Staff failed to intervene or redirect to prevent the children from engaging in activities that were detrimental to their health and well-being while on the playground. There were no injuries and no professional medical attention due to the incident.

Professional medical attention was sought for the child as a result, and the child was diagnosed with temporary memory loss. The staff member was unaware that the child had been hit and did not provide immediate assistance to the injured child, until another child brought it to the staff member's attention. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

Center Staff members were unaware that the one-year-old child was having a seizure for over nine seconds on the playground as staff had their backs turned to their assigned playground. Staff were observing a child on an adjacent playground and the child required professional medical attention. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

During a Complaint Closure conducted on July 24, 2024 ; It was determined based upon investigative findings that a staff member failed to provide adequate supervision when a three-year-old child was left outside on the playground and was sitting outside the classroom door for approximately seven minutes. An adult walked from the center parking lot and knocked on the classroom window to notify staff inside the classroom that the three-year-old was child sitting outside the classroom door and was alone on the playground. 591-1-1-.07(1) · Rule 591-1-1-.07(1) requires Center Staff to not accept a child nor allow a child to remain at the Center if the child has the equivalent of a 101 degree Fahrenheit or higher oral temperature and another contagious symptom, such as but not limited, a rash, diarrhea or a sore throat. When a child shows symptoms of illness during the day, the child shall be moved to a quiet area away from other children where the child shall be supervised and provided the necessary attention until such time as the child leaves the Center or is able to return to the child’s group.
During an Incident Investigation Closure conducted on June 24, 2024, it was determined that on February 6, 2024, center staff failed to move a one-year-old child to a quiet area away from other children after determining that the one-year-old child had a fever of 102.9 Fahrenheit. The classroom staff member took the child to the center administration to take their temperature, and their parent was contacted and asked to pick the child up. Staff returned the child to the classroom and the class went outside on to the playground. While on the playground the child had a seizure and required professional medical attention.

During an investigation, it was determined that on May 26, 2023, a staff member was not alert and did not provide watchful oversight when a staff member was unaware that an eight-year-old child was struck by a tire swing on three occasions. On the last occasion that the child was struck by the swing tire, the child banged their head on a pole, which caused them to fall to the ground. As the staff member was unaware that the child had been hurt and fallen to the ground, the staff member did not immediately attend to the needs of the child. Another child had to notify the staff member that the child was hurt and was on the ground. The child remained on the ground for approximately one to two minutes before the staff member attended to the child. The eight-year-old child was notably confused and could not recognize familiar people. Professional medical attention was sought for the child as a result.

During an investigation, it was determined that on August 10, 2022, during lunch time a four-year-old child was thumped on the head by a staff member as a form of discipline.

During an investigation, it was determined that on July 16, 2021, center staff engaged in physical corporal punishment when a staff member poked at least three one-year-old children in the back and side with a thumb tack as a form of classroom management and discipline. A staff member was observed by another staff member and on video surveillance to push a thumb tack into the one-year-old children’s backs while moving them to the carpet to watch a movie. Additionally, it was determined that the same staff person grabbed one-year-old children by the arm and aggressively moved the children on to the carpet to watch a movie. The staff member handled the children in a manner that could have caused injury. The staff member was terminated as a result of the incident and later arrested and charged with cruelty to children.
