    591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children shall be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.

    During an investigation, it was determined that on February 6, 2026, adequate supervision was not provided when a 4-year-old child sustained an injury after jumping from a piece of playground equipment. During outdoor play, the child jumped from a platform measuring 5 feet, 11 inches and landed on the ground. A staff member saw the child crying and asked what was wrong. The child informed the staff member that they had fallen. The child received professional medical attention for a fractured foot. Staff members did not provide watchful oversight and were not aware of the incident and injury until being informed by the child.

    591-1-1-.29(3) · Rule 591-1-1-.29(3) requires that the Director or designated person-in-charge shall report or cause to be reported to the Department within twenty-four (24) hours or the next work day: any death of a child while in the care of the Center; any serious illness or injury requiring hospitalization or professional medical attention other than first aid of a child while in the care of the Center; any situation when a child in care becomes missing, such as, but not limited to, a child who is left on a vehicle, a child who leaves the building, playground, or property, or a child who is left behind on any trip; any fire; any structural disaster; any emergency situation that requires temporarily relocating children; and any time the program’s operating status changes (i.e., open to closed or temporarily closed and temporarily closed to open).

    During an investigation, it was determined that on February 6, 2026, a 4-year-old child sustained a fractured right foot after jumping off a piece of playground equipment. The center was made aware on February 9, 2026, that the child received professional medical attention for the injury. The center did not report the incident to the Department as required.

    During an investigation, it was determined that on February 6, 2026, at approximately 4 p.m. there was staff:child ratio of 1:16 on the playground, on two separate occasions, when the second staff member went into the center. The group was made up of children ages 3 to 5 years, and since the 3-year-old children made up more than 20% of the group, a second staff member was required to be present to meet the ratio of 1:15 for 3-year-old children.

    During an investigation, it was determined that on November 30, 2023, a four-year-old child was not kept clean, dry and comfortable when the child was left alone on the playground for approximately 24 minutes. While the child was missing, the child urinated on their clothing, and was crying at the time they were found. Additionally, it was determined that at the time of the incident the outdoor temperature was 52 degrees, and it was dark outside. The child received professional medical treatment as a precaution.

On November 30, 2023, at 4:50 p.m. 16 children were on the playground with two staff members. At 5:00 p.m., one staff member left for the day and an additional staff member joined the class outside on the playground. The class transitioned from the playground at 5:50 p.m. and went inside with the two staff members. Staff did not ensure all children had exited the playground, and staff were unaware the child was missing. At 6:14 p.m., the four-year-old child’s parent arrived for pick-up, it was discovered that the four-year-old child was not present in the classroom. The child was found outside on the playground alone, and the temperature was 52 degrees at the time the child was found. It was further determined that on the day of the incident, the sun set at 5:31 p.m., and that at the time the child was found, it was dark outside. The child was unsupervised for twenty-four minutes. The child received medical attention as a precaution.

Two staff members were seen on video footage talking to one another at the time of the incident and did not see the children by the door until after the incident. The child sustained an injury to their hand that required professional medical attention.
